'Prayatna' is an effort of dedicated SLIET students who cherish social work as their way of life. the organisation is headed by Dr. Pardeep Jain, Asst. Professor (Dept. Of Management, SLIET) and and the cause is further helped by Prof. Manoj Goyal & Dr. Sarika Jain and involves active participation of students from all streams.

Dr. Jain has done his M.A (Economics), M.B.A, LL.B and Ph.D in management and is involved in social activities for the last twenty years. He is also working as an educator and motivational speaker and has spread his message to more than 50,000 persons across India. Prof. Goyal, who is an M.Tech(Mechanical), has been working in close collaboration with Dr. Jain for the last 17 years. together, they have conducted more than 100 workshops on communication skills, personality development, meditation and yoga and spiritualism. The beneficiaries of these workshops range from students, police , bank officers, forest officers, teachers and various other public and private sector organisations.

ORDER

It is observed that the present complaint is against the PIO/Sant Longowal Institue of Engineering and Technology, which is a deemed university established by the Union Government. The State Information Commission, Punjab has no jurisdiction over the public authorities established by the Union Government. Appropriately, the complainant should move the Central Information Commission. Hence the complaint case is closed with an advisory to the complainant that he may, if he so likes, move the Central Information Commission.

(1). The petitioner seeks quashing of the order dated 22.11.2007 (Annexure P14) whereby respondent
No.1-Institute has declined to release the arrears of revised pay on the plea that the petitioners appointment on deputation in respondent NO.1- Institute itself was irregular.

(2). The petitioner is a Professor in Hindi in the Himachal Pradesh University at Simla. Her husband was appointed as Director of respondent No.1-Institute for a period of five years. The petitioner was also taken on deputation by the respondent-Institute against the post of Counsellor-cum-Chief Warden (Girls) vide order dated 15.07.1999 (Annexure P2) w.e.f. 01.08.1999. The petitioner admittedly served the respondent-Institute on deputation till she was repatriated vide order dated 23.07.2004 (Annexure P10). The petitioner relinquished the charge vide report dated 26.07.2004 (Annexure P11) and joined her parent University at Simla.

(3). It is also not in dispute that much after the petitioner had joined the respondent-Institute in the unrevised pay-scale w.e.f. 2nd August, 1999, the pay-scales of the teaching faculty/employees of the respondent- Institute were revised retrospectively w.e.f. 01.01.1996. The petitioner also claims re-fixation of her pay in the revised pay-scale and consequential arrears for the period she remained on deputation with the first respondent. As noticed earlier, her claim has been turned down on the plea that as per the objection raised by the Accountant General (Audit), Punjab, the petitioners appointment in respondent-Institute was irregular.

(4). Respondent-Institute has filed its reply/affidavit reiterating that the arrears of revised salary could not be paid to the petitioner due to the objection raised by the Audit Department against her appointment.
(5). Having heard learned counsel for the parties and on perusal of the record, I am of the considered view that the writ petition must succeed.

(6). There is no denial to the fact that the petitioner worked with the respondent-Institute on deputation from 02.08.1999 to 26.07.2004. The petitioner was taken on deputation with prior approval of her principal employer, namely, the Himachal Pradesh University and her appointment on deputation was
preceded by all the procedural formalities including approval by the Board of Governors of respondent- Institute. She was also paid salary in the pre-revised pay scale meant for the post occupied by her. The respondents cannot now turn around and deny the arrears of revised pay to the petitioner on the pretext
that the Audit Department has raised some objection against her appointment. No provision has been quoted or cited mandating the consent/approval of Audit Department for suck like appointment(s). The objection, if any, raised after the petitioner stood relieved from the deputational assignment cannot take away the benefit already accrued in her favour.

(7). For the reasons afore-stated, the writ petition is allowed; the impugned order dated 22.11.2007 (Annexure P14) is hereby quashed and the respondents are directed to release the arrears of revised pay in favour of the petitioner for the period she worked on deputation along with interest @ 7% per annum within a period of three months from the date of receipt of a certified copy of this order.

Since common questions of law and facts arise in all these writ petitions, same are being disposed of by this common order.

It is necessary to refer to the factual background separately in each case.

CWP No.9104 of 2008
The petitioners in this case were recruited/appointed as Lecturers in respondent No.1 Institute in the discipline of Mechanical Engineering against the available vacancies.

They were granted the benefit of Carrier Advancement Scheme (hereinafter referred to as the CAS) after putting in requisite number of years of service in terms of the AICTE decision dated 19.09.2003. This benefit is like Assured Career Progression Scheme and does not amount to a regular promotion to the next higher post of Assistant Professor in the department. While the petitioners were working in the Institution in the above capacity, respondent No.1 advertised four posts of Assistant Professors in the Mechanical Engineering in the regular pay scale of Rs.12000-18300/- vide notification No.02/06 dated 089.11.2006, published in Hindustan Times in its issue dated 19.09.2006. Vide a subsequent corrigendum published in Hindustan Times on 21.01.2007, the last date for receipt of the applications was extended and one post of Assistant Professor was reserved for persons with disabilities. The petitioners applied for the posts in question along with other persons.

As many as 33 persons applied for the four posts. It is alleged that petitioner No.1 occupied slot No.1, petitioner No.2 was placed at Serial No.3 in the merit list, whereas respondent No.3 was placed at Serial No.2 and respondent Nos.4 and 5 were placed at Serial Nos.4 and 5, respectively. Respondent No.1, however, appointed respondent Nos. 3 to 5 against three available posts of Assistant Professors in Mechanical Engineering ignoring the higher merit of the petitioners attained in the selection process and their preferential claim for appointment over and above the private respondents.

CWP No.8574 of 2008
The petitioners in this case were initially recruited as Lecturers in the discipline of Computer Science and Engineering in respondent No.1 Institute in the year 1992 and on the basis of the decision of the AICTE referred to above. They were granted the benefit of Carrier Advancement Scheme and made Assistant Professors. While they were working as such, respondent No.1 Institute advertised number of posts of Assistant professors in various disciplines including the Computer Science and Engineering vide notification referred to above while dealing with CWP No.9104 of 2008. As many as four posts of Assistant Professors were advertised for the discipline of Computer Science and Engineering. The petitioners applied for the posts in question and were considered along with other applicants. It is claimed that the petitioners occupied Slot No.1 and 2 in the merit list whereas private respondent Nos.3 to 5 occupied positions 3 to 5. Despite their higher merit acquired in the selection process, the petitioners have been ignored and private respondents appointed as Assistant Professors in the discipline of Computer Science and Engineering.

CWP No.9894 of 2008
In this writ petition, petitioner was recruited as Lecturer in the Mathematics in respondent No.1 Institute. Two posts of Assistant Professors in Mathematics were advertised along with other various posts of Assistant Professors in various disciplines in respondent No.1 Institute vide notification referred to here-in-above. The petitioner also applied for the said post claiming to be eligible. He was considered for selection by the appropriate Selection Committee. It is alleged that the petitioner occupied second position in the merit list whereas respondent No.4 was placed at Serial No.1. Respondent No.4 secured 59.2 marks as against 53.9 marks secured by the petitioner.

Resultantly, respondent No.4 being at Serial No.1 was selected/appointed and the petitioner who was at serial No.2 of the Select list was not offered appointment. The petitioner applied under the Right to Information Act which information was denied to him.

However in appeal he has been supplied the information wherein the claim of the petitioner is found to be correct.

Respondent Nos.1 and 2 and private respondents have filed their separate replies.

From the replies filed by the Institutional respondents and private respondents, factual averments made in the writ petitions are admitted. The merit positions attained by the petitioners in all the writ petitions qua private respondents stand admitted and established from record. Respondent Nos.1 and 2, however, have attempted to justify the non-selection of the petitioners on the grounds that they are already designated and working as Assistant Professors under CAS. The pay scale and status of the petitioners is the same as directly recruited Assistant Professors. It is also the case of respondent Nos.1 and 2 that station seniority of the petitioners is being maintained at par with the direct recruits Assistant Professors for all purposes and other benefits like House Rent Allowance etc. It is further mentioned that some of the petitioners while working as Assistant Professors are functioning as Head of the Departments in their respective disciplines. Thus, for all practical purposes, they are Assistant Professors.

It is specific case of the petitioners that the directly recruited Assistant Professors are to be placed on a higher place in the seniority list as against the Assistant Professors promoted under the CAS in view of the judgment of the Honble Supreme Court in the case of Dr.Rashmi Srivastava Vs. Vikram University and others, AIR 1995, Supreme Court, 1694. In view of the judgment of the Honble Apex Court,Government of India, Ministry of Human Resources Development and Higher Education, New Delhi, has also issued clarificatory notification dated 13.12.2006 certifying that the direct recruits and promotees under the CAS are two different and distinct categories. It is further clarified that the promotion under the CAS is not linked to a physical vacancy and it is only personal to the candidate. Similar clarification has been issued by the AICTE vide its communication dated 19.09.2003 to all the State Governments, Union Territories and the Secretaries, Technical Educations, stating that direct recruits will be considered senior to the persons promoted under the CAS in view of the norms adopted by the University Grants Commission whereby CAS was introduced.

The clarificatory letter from the Ministry of Human Resources Development dated 13.12.2006 specifically provides for maintaining two separate seniority lists-one for the direct recruits and other for CAS promotees.

The selection/appointment with respondent No.1 Institute is regulated by Rules and Regulations framed by the All India Council of Technical Education, notification dated 15.03.2000. Respondent No.1 being affiliated and recognised Institute is bound to follow the mandate of Articles 14 and 16 of the Constitution of India. There is no difference of opinion on this issue between the parties.

It is admitted position that petitioner No.1 in CWP No.9104 of 2008 has higher merit than all the private respondents being at Serial No.1 of the select list whereas petitioner No.2 is higher in merit than respondent Nos.4 and 5 being at Serial No.3 in the merit list. As many as four vacancies were advertised, but only three have been filled up.

One post is still lying vacant.

From the select list, it appears that no reasons have been recorded for denying appointments to the petitioners even though they have better merit than the selectees/appointees i.e private respondents in the manner indicated here-in-above.

It is, however, argued by Mr. RK Malik, learned Senior Counsel, appearing for the private respondents that some of the private respondents have joined the Institute by resigning from other Institutes and the petitioners being already working as Assistant Professors, they are not prejudiced in any manner. His further argument is that since the vacancies stands occupied and the private respondents are not parties in any wrong decision taken, they cannot be thrown out.

It is admitted position that the petitioners have been denied the appointment despite acquiring higher merit in the process of selection without any valid reasons. This itself is sufficient to allow these writ petitions. There has been gross violation of the mandate contained in Articles 14 and 16 of the Constitution of India. Mere fact that some of the private respondents have resigned from other posts/Institutions and joined the respondent No.1 Institute and that they are allegedly not parties to the wrong decision, does not dilute the enforceability of the mandate contained in Articles 14 and 16 of the
Constitution of India. Fact remains that the petitioners have been deprived of their right of appointment in gross violation of their fundamental rights and despite their better merit in the process of selection. The private respondents are beneficiary of illegal and wrong orders passed by respondent Nos.1 and 2 and, thus, they are contributory to the violation of law.

Mr.RK Malik, learned Senior Counsel has further argued that if the petitioners can be adjusted without disturbing the private respondents, they will have no objection in this regard.

In CWP No.9104 of 2008, one post is still lying vacant against which petitioner No.1 can be conveniently adjusted/appointed.

However, petitioner No.2 is also higher in merit than respondent Nos.4 and 5 and in order to make room for petitioner No.2, respondent No.5 has to go out being the last selectee in the merit list. In the event respondent Nos.1 and 2 are willing to adjust petitioner No.2 at Slot No.2 without disturbing respondent No.5, they are at liberty to do so.

However, in the event it is not feasible or possible to add one vacancy of Assistant Professor for any valid reasons, appointment of respondent No.5 shall stand cancelled and petitioner No.2 shall be appointed in his place at his own merit as per the select list.

In CWP No.8574 of 2008, admittedly, petitioner Nos. 1 and 2 were at Serial Nos.1 and 2 of the merit list. Out of four advertised vacancies, one vacancy is still lying vacant and petitioner No.1 can be adjusted against the available vacancy. The same principle will apply for adjustment of petitioner No.2 as in CWP No.9104 of 2008.

In CWP No.9894 of 2008, the petitioner is, admittedly, at Serial No.2 in the select list and only one vacancy has been filled up and the private respondent is also, admittedly, higher in merit than the petitioner. If respondent Nos. 1 and 2 intend to fill up the second vacancy within one year from the date of this order the petitioner in this case shall be given preference and adjusted against the available vacancy. However, if respondent Nos.1 and 2 have no intention to fill up the vacancy, the petitioner shall have no right of appointment in view of the settled legal position that the selectee has no right for appointment if the employer do not want to fill up the vacancy for any valid reasons. The respondents are directed to pass consequential order in view of the above directions within a period of one month from the date a certified copy of this order is made available to them.

For the reasons recorded above, these writ petitions are disposed of in terms of the aforementioned directions.

Students body found

The body of a student of the Sant Longowal Institute of Engineering and Technology (SLIET), Longowal, was today found from his room in the hostel of the institute. It is suspected that he had consumed some poison. According to local DSP Pritpal Singh Thind here tonight, the deceased, Varinder Kumar, who was from Hamirpur in Himachal Pradesh, was a student of diploma in food processing.

Remand for 18 SAD (A) men: The Sunam police on Thursday arrested Hakam Singh, of Satauj village (near Sunam), and allegedly recovered the bag, containing some currency notes and tickets, of the conductor of an Orbit bus. He also said Hakam Singh and 17 other activists of the SAD (A) were produced in a court at Sunam, which remanded them in judicial custody till January 23.

Control of Sant Longowal Institute restored to Punjab

Changing the decision of the previous BJP-led Government at the Centre, the Union Ministry of Human Resources Development has restored the administrative and other control of the prestigious Sant Longowal Institute of Engineering and Technology (SLIET), to the Punjab Government.

In a clever and discreet move, the previous BJP Government had not only decided to change the name of the institute but also to have a complete control over it by revising the Memorandum of Association (MoA) that was signed between the state government and the Centre while setting up this institute in late ‘80s. Under the MoA, a society was set up to run the institute.

In a letter to the Chief Secretary, Mr Jai Singh Gill, the Joint Secretary of the HRD Ministry has stated that the meeting dated December 4, 2003, was convened by the Union Government without the approval of the Chairman of the Board of Governors of the institute and in violation of the clause 11 (i) of the rules of SLIET. It has been further observed that the rules (MoA) of the society cannot be amended without prior approval of the state and the Central Governments.

On receiving this letter the Punjab Government, which has been struggling hard to get undone the decision of the previous government to transfer the control and change the name of the SLIET, has heaved a sigh of relief.

At the December 4, 2003, meeting, the decisions of which now stand undone by the HRD Ministry, a decision was taken to change the word ‘Sant Harchand Singh’ and ‘Central’ in the main body of the name of the institute and rename it as Sant Harchand Singh Longowal Central Institute of Engineering and Technology and to revise the MoA besides registering the revised MoA, afresh with the Registrar, Firms and Societies concerned.

The motive behind changing the MoA was to get all the powers for the appointment of the Board of Governors by the Union Government.

When the Punjab Government came to know about the decisions of the December meeting, that was convened without taking its consent, the matter was taken up immediately with the Union Government but it turned a deaf year to what the Punjab Government said.

After the change of the government at the Centre, the Chief Minister, Capt Amarinder Singh, wrote a detailed demi official letter to the HRD Minister, Mr Arjun Singh, informing him about the “ discreet game” played by the previous government with regard to the wresting of the control of the SLIET.

Meanwhile, to set the house in order at SLIET, Mr Jai Singh Gill has ordered the suspension of Dr R.C. Chauhan, Director, SLIET.

Fasting students seek doctors removal

Students of the Sant Longowal Institute of Engineering and Technology (SLIET) staged a dharna and began a relay fast at the main gate of the institute here today demanding the removal of Dr Kuldip Singh, posted at the health centre of the SLIET, while holding the doctor responsible for the death of a student, Vikrant Singh, who was seriously injured in a road accident near here and later died on the way to Ludhiana a few days ago.

The students have also demanded the removal of Dr V. Sahni from the post of Dean (Welfare) of the institute, alleging that his attitude towards the students was not proper and he had not played an appropriate role after the death of Vikrant Singh.

On the other hand, Dr R.C. Chauhan, Director of the SLIET, has ordered an inquiry into the alleged negligence of Dr Kuldip Singh in the case of Vikrant Singh’s death. The inquiry will be conducted by Dr Anand Vaz, Dean, Academic, of the institute. Besides, the Director has also entrusted the functions of the Dean (Welfare) to Prof V.K. Jain till further orders.

A large number of students, including girls, raised slogans against the authorities. The student leaders stated that their fast would continue till the acceptance of their demands.

The girl students alleged that they had been living in the hostel as “jail inmates”. They claimed that their STD booth had been closed the previous day so that they could not talk to anybody. Besides, the authorities had also asked the students of diploma and certificate courses to remain inside the hostels. It was alleged that a list of about 100 girl students, who had participated in the strike, had been prepared by the SLIET authorities to take action against them.

The girls announced that they would also participate in the relay fast to express their solidarity with their institute.

Talking to mediapersons, Dr R.C. Chauhan, Director of the SLIET, said he had sent Dr Kuldip Singh on leave and instituted an inquiry against him on the recommendations of a fact-finding committee. He further said the committee had given a clean chit to Dr V. Sahni, Dean (Welfare). However, he added that on the request of Dr V. Sahni for immediate relief on health grounds, the functions of Dean (Welfare) had been entrusted with Prof V.K. Jain till further orders.

Sant Longowal Institute of Engineering & Technology (SLIET) was established by Government of India through Ministry of Human Resource Development as a national level institute. In the year of 2007, it was entitled as a deemed university.

Sant Longowal Institute of Engineering and Technology is an autonomous body, fully funded by Government of India and controlled by SLIET Society. The institute was previously affiliated to Punjab Technical University. However, it was later accorded the status of Deemed University.

The institute was conceived by the government of India in 1985 as a tribute to late Sant Harchand Singh Longowal. SLIET has separate Boys and Girls Hostels (09 Boy's Hostels and 2 girl's hostel).The capacity of each hostels are 235 students, and the capacity of PG Hostel is 80 students.
