Complaint under Section 12 of the
Consumer Protection Act, 1986.
This order shall dispose of a complaint under Section 12 of the Consumer Protection Act, 1986( hereinafter referred to as the 'Act') instituted by the complainant against the opposite party . The brief facts of the complaint are that the complainant wanted to take admission in Engineering and was approached by the opposite party at
Sundernagar in the month of July for admission in their college . The opposite party had come to Sundernagar for advertisement and they seduced the complainant for joining the college . The opposite party had succeeded in obtaining Rs.35,500/- as fee and Rs.32,000/- as hostel fee from the complainant . The complainant alleged that he came to know that the opposite party's College was not authorized to run I.T. Trade whereas the opposite party had proclaimed that it has authority to run the said course for more than one year. Consequently, the complainant attended the college for one month when he came to know that the college did not have facilities nor recognized teaching staff and he discontinued . With these averments the complainant has sought a direction to the opposite party to refund Rs.67,500 /- to him alongwith damages. Apart from this, cost of the complaint has also been claimed.

The opposite party has resisted the complaint and raised preliminary objections that the complaint is liable to be dismissed since the complaint did not fall under the territorial jurisdiction of this Forum in view of section 11 of the Act as the opposite party is situated at Lalru, District Mohali in the State of Punjab where the payment has been made and receipt was issued , that the complainant has not approached this Forum with clean hands , this Forum has no jurisdiction to entertain and adjudicate upon the dispute involved in the complaint as it did not constitute a consumer dispute and it can only be tried by a civil court , that the complainant has nowhere made allegations of deficiency in service of the opposite party, that there is absolutely no negligence on the part of the opposite party, that the complaint is bad for non joinder of necessary and proper parties , that the complaint is baseless and flagrant abuse of process of law and that the complaint is also liable to be dismissed since the matter is contractual in nature between the two private parties and the parties have agreed to the terms and conditions before entering into the contract. On merits , the allegations made in the complaint have been denied in totality .It has been contended that the opposite party college had already entered five years of its operations in other Engineering college SPCET under the same management in the academic year 2008-2009. The strength of technical facility is around 18 and the opposite party is headed by a renowned educationist Dr. Jyoti Kaul Mattoo Principal of the College holding a Doctorate Degree . The entire teaching facility is well qualified holding qualifications of B .Tech and M .Tech . That the opposite party college is duly recognized and is affiliated to Punjab Technical University Jallandhar and approved by AICTE, New Delhi as per Annexure -2. It has been contended that the complainant was admitted to the opposite party college strictly in accordance with the rules and guidelines laid down by the University in this regard in the academic session 2008-09. The annual fee for the first year was Rs.97,885/- which was to be payable in two equal instalments in April and November except the admission fee and PTU counseling fee. The complainant was required to deposit the amount as under :-

It has further been averred that after filling the application from duly signed by the complainant and his father , they deposited 50% of the total fees and complainant had been admitted in the college in I.T trade. After that on 18-7-2008 father of the complainant made categorical request in writing to the opposite party to provide hostel facility and assured to deposit the total fee of the hostel alongwith the balance amount of Rs.2280/- and hostel was duly provided to him. Apart from hostel fees of Rs.30,000/- the complainant was also liable to deposit a sum of Rs.2000/- as security deposit for hostel refundable after four years . Thus the complainant was required to deposit Rs.34,280/- and he had deposited Rs.32000/- on 8-8-2008. It has further been contended that the performance of the complainant was very poor in the class rooms and he was warned many a times by the teachers to be more attentive and careful but the complainant was not serious about his studies and he failed to clear the examination and he secured Zero and Seven marks only in two subjects which is evident from answer sheets of the complainant Annexure R-4 and R-5. On 18-11-2008, the complainant gave a request in writing to withdraw from the seat and asked back for his certificates which were duly received by him on the very same day and it has been mentioned in the letter that nothing is pending against the college The copy of the letter is Annexure R-8 With these averments , the opposite party has prayed for dismissal of the complaint.
3. The complainant had filed rejoinder reiterating the contents of the complaint and denied those contrary to the complaint.
4. We have heard the ld. counsel for the parties and have also gone through the entire record. The complainant has filed this complaint on the allegations that the opposite party had come to Sundernagar for advertisement regarding their college and they allured the complainant for joining the college and succeeded in obtaining Rs.35500/- as fee besides Rs.32,000/- as hostel charges The ld. counsel for the opposite party vehemently argued that this Forum has no territorial jurisdiction to try and entertain the present complaint as no part of cause of action has arisen within the territorial jurisdiction of this Forum.
5 From the perusal of the pleadings of the parties and rival contentions raised , the question which arises for consideration before this Forum is as to whether this Forum has territorial jurisdiction to entertain and decide the present complaint. As per section 11 of the Act , the Forum will have the jurisdiction to entertain the complaint within the local limits of whose jurisdiction the opposite party resides or carries on business or where the cause of action wholly or in part arises. At this stage , it would be appropriate to reproduce relevant extract of section 11 of the Act which reads as under:-
(2) A complaint shall be instituted in a District Forum within the local limits of whose jurisdiction,-
(a) the opposite party or each of the opposite parties, where there are more than one, at the time of the institution of the complaint, actually and voluntarily resides or carries on business or has a branch office or personally works for gain or
(b) any of the opposite parties, where there are more than one at the time of the institution of the complaint, actually and voluntarily reside or carries or business or has a branch office, or personally works for gain provided that in such case either the permission of the District Forum is given ,or the opposite parties who do not reside, or carry or business or have a branch office or personally work for gain as the case may be, acquiesce in such institution; or
(c) the cause of action, wholly or in part , arises.
6 Admittedly the opposite party neither carries on business nor is residing nor is having any branch office within the jurisdiction of this Forum. Therefore, the case of the complainant does not fall within the ambit of Section 11(2) (a) &(b) of the Act.
7 Now the next question which arises for determination is as to whether the cause of action wholly or in part has arisen in favour of the complainant within the territorial jurisdiction of this Forum. The case of the complainant is that in the month of July, the opposite party had come to Sunder Nagar for advertisement regarding admission in their College and the complainant was approached by it at Sunder Nagar and the opposite party succeeded in obtaining Rs.35,500/- as fee and Rs.32,000/- as hostel fee. However, no evidence has been led by the complainant to show that any part of cause of action has arisen in his favour within the territorial jurisdiction of this Forum. The perusal of copy of receipt No.062 dated 18-7-2008 in the sum of Rs.35,500/- and copy of receipt No.153 dated 8-8-2008 in the sum of Rs.32,000/- adduced by the opposite party in evidence show that the payments were received by the opposite party at Lalru where the Institute of the opposite party is situated. In the rejoinder , the complainant has mentioned that the agreement for studying in the college of the opposite party was reached at Sunder Nagar where its staff and employees have installed a saloon and were inducing and cajoling the students to enter in their college However, no documentary evidence has been filed by the complainant to show that any agreement was arrived at between the complainant and the opposite party at Sundernagar. The mere fact that the opposite party had installed its booth at Sundernagar for advertisement of its college will not confer the jurisdiction on this Forum . In the absence of any material placed on record, it can not be said that the cause of action or any of its part had arisen in favour of complainant within the territorial jurisdiction of this Forum . Therefore, his case does not fall within the ambit of section 11(2) ( c) of the Act also . Hence, in the entirety of the facts and circumstances of the case, we are of the firm opinion that this Forum has no territorial jurisdiction to entertain and decide the present complaint.
8 In the light of above discussion, the complaint is dismissed for want of territorial jurisdiction. However, the parties are left to bear their own costs .
