1 The case relates to seeking information regarding grants received by the Respondent from UGC and DPI colleges and also details of income from the landed property. The information requisitioned covered period from 2004 to 31.10.2007. Initial request was made on 06.11.2007 through a registered letter. However, the said letter was returned to the sender as the Respondent refused to accept the same. The Complainant filed a complaint with the Commission on 13.11.2007 alongwith the original request for information and the envelope containing the initial request. The envelope has an endorsement by the Postal Department.

2 On the last date of hearing on 03.01.2008, on request of the Respondent, the case was adjourned.

3 During today’s proceedings, the Respondent requests for additional time to provide information to the Complainant. The Respondent confirms that Sri Guru Gobind Singh College, Sanghera, Barnala is a government aided college and falls within the purview of Section 2 (h) of the RTI Act. It is observed that the Respondent had not provided any information to the Complainant even though a copy of the Complainant’s letter dated 13.11.2007 had been sent alongwith the notice sent on 18.12.2007.

4 It is, therefore, directed that requisitioned information will be provided to the Complainant by registered post free of cost by 15.02.2008 with a copy to the Commission.

Profile of Guru Gobind Singh College GGS Sanghera

Historical Background of the College
The public of Sanghera, its surrounding villages, and also of Barnala had been feeling the need of rural Degree College since long at or near Barnala. In pursuance of these feelings and in order to meet this long standing demand, Gram Panchayat of Sanghera took up the initiative and donated some land for constructing a college. Accordingly a charitable trust, known as Guru Gobind Singh College Trust Sanghera was formed and registered in 1969. The donated land of the Gram Panchayat of Sanghera was transferred to this trust and Guru Gobind Singh College was established in July 1972 on the Barnala-Ludhiana Road at Distance of 2 km from Barnala.

Besides imparting instruction up to Degree level, the college also provides training in the National Cadet Corps and National Service Scheme. Arrangements exist for all major and minor games for boys and girls in the college. In order to develop and talents of the students a number of cultural and literary societies have been formed in the college. It brings out its magazine, Patrika, once a year. The students of this college are eligible for the award of all types of university, government and other scholarship. The number of students on the rolls of the college, during 1977-78, was 101.

The Managing Committee, Guru Gobind Singh College, Sanghera, Barnala, District Sangrur, has filed the present writ petition praying that the respondents be directed to immediately release the grant-in-aid of 95% along with arrears, which is pending, so that the salaries to the employees can be disbursed by the petitioner. It has been stated in letter dated 4.12.2006 (Annexure P7) that arrears to the tune of Rs.7,73,439/- were due till the session 2005-2006. It has been further stated in letter dated 20.2.2007 (Annexure P8) that arrears due to nonpayment increased and accumulated upto Rs.19,45,433/- till February 2007. It is stated that the aforementioned amount is not being released to the petitioner by the respondents.
Learned counsel for the State, however, submits that various objections have been raised and the petitioners have not cleared the same and hence, the amount has not been paid to the petitioners.

Learned counsel for the State further submits that the State Government has imposed a cut of 10% from 21.12.2001 and as the cut has been applied to all the grant-in-aid affiliated Colleges throughout Punjab, hence, the petitioners have not been paid the amount as prayed for.

Mr. Pawan Kumar, learned counsel for the petitioners has placed reliance on the judgments State of Maharashtra v. Manubhai Pragaji Vashi and Others (1995) 5 Supreme Court cases 730, Government of A.P. and Others v. G.V.K.Girls High School, (2000) 8 Supreme Court Cases 370, and State of Haryana and others v. Babita Yadav and Others (2004) 13 Supreme Court Cases 734, to
contend that the paucity of funds or financial contributions cannot be taken a ground to deny the grant-in-aid to Government recognized private colleges while extending such facility to recognized private colleges by the State.

After hearing the learned counsel for the parties, we are of the considered view that the case of petitioners is squarely covered by the decision in the State of Maharashtra v. Manubhai Pragaji Vashi and Others, Government of A.P. and Others v. G.V.K.Girls High School, State of Haryana and others v. Babita Yadav and Others (supra). The State Government cannot take up the ground that due to paucity of funds, it is unable to give grant-in-aid to the colleges.

In view of the above, we hold that the respondents shall pay 85% of the grant-in-aid as claimed by the petitioners within a period of three months, after the clearance of the objections by the petitioners.

The petitioners shall try to clear all the objections raised by the State Government within a period of one month from today.

As far as the balance 10% of the amount of grant-in-aid case is concerned, the petitioners may submit a separate representation to the respondents. The respondents are also further directed to release the grant-in-aid to the petitioners in future also in time.

The writ petition stands disposed of.

C.M.No.22125-26-CII of 2009 Applications are allowed subject to all just exceptions. As per the averments made in this case, vide judgment dated 19.3.2008 passed in CWP No.3191 of 2007, the respondent-State was directed to release the grant in aid payable to the petitioner within a period of 3 months after the clearance of the objections by the petitioner. Vide aforesaid judgment, it was also directed that the respondents will release, the grant in aid to the petitioner in future also, in time.

Undisputedly, during the course of proceedings, certain amounts have been paid to the petitioner as arrears of grant in aid. Vide order dated 26.5.2009, it was observed that the respondents have paid a sum of Rs. 13,56,433/- and it was observed that the order passed by this court dated 19.3.2008 stands complied with.

Now the grouse of the petitioner is that since May, 2009 till date, no amount pertaining to the grant in aid has been released to the College and thus the respondents are guilty of committing the contempt of this court.

Admittedly, the bill for release of the aforesaid amount of grant in aid has been submitted by the petitioner on 9.9.2009. A perusal of the Division Bench order of this court shows that the respondents were given three months time to release the payment of grant in aid after clearance of the objection by the petitioner which are raised by the respondents. There is no such averment made in this application with regard to the aforesaid fact and in any case the bills have been submitted by the petitioner only on 9.9.2009 and it cannot be said that the respondents have committed violation/disobedience of the orders passed by this
court by not releasing the payments of these bills.

Thus, I find no ground to continue with this contempt petition any further. Dismissed.
