Vide application dated 07.04.2011, Sh. Jatinder Mohan Chaudhary sought the following information under the RTI Act, 2005:

“1. Are part-time lecturers eligible for availing leave?
2. What are the terms and conditions for part-time lecturers to avail leave?
3. What is the maximum duration for which a part-time lecturer can go on leave?
4. Who is the competent authority to sanction leave for part-time lecturers?
5. When did Mr. Bhupinder Singh (part-time lecturer in Political Science Department) go on leave and the period for which he applied for leave?
6. Name and designation of the competent authority who had sanctioned the leave of Mr. Bhupinder Singh;
7. Has Mr. Bhupinder Singh applied for extension of leave?
8. What is the reason stated by Mr. Bhupinder Singh for demanding leave and for extending leave (if he has applied for extension?
9. Copies of the first leave application of Mr. Bhupinder Singh and application for extending leave.”

The present complaint has been filed with the Commission on 19.05.2011 as no information was provided.

A letter has been received from the respondent wherein, it is stated: -

“Q1: Whether Part Time lecturers are eligible for any leave.
Response: According to DPI (C) Punjab letter no 10/116-91 S(5) dated 29.03.1995, they are not entitled to any leave except Sundays and any holidays declared under negotiable act.

Q2: Who can sanction leave?
Response: According to DPI (C) Punjab, letter no 2052-9/48-2010 S(3) dated 12.05.2010 principal of college can issue NOC to the concerned lecturer. The copy of the same letter was provided to the complainant at the time of the hearing on 20.07.2011.

A3: Why the services of Mr. Bhupinder Singh were not terminated after three months?
Response: There are no instructions in written regarding the authority of the principal to terminate the services of any lecturer. The college has put up the case with DPI (C) Punjab. Further instructions are awaited.”

I have gone through the documents and am of the view that information as per the original application stands provided.

Sh. Jatinder Mohan Chowdhry submitted the following discrepancies in the information: -

“1. In reply to paragraph no. 1,2,3 of my application, respondent has replied the part-time lecturers are not eligible for availing any leave except Sunday and other public holidays. Respondent have also attached copy of Memo no. 10/116-91/S(5) dated 24.03.1995 Punjab.

2. In reply to paragraph no. 4 of my application, respondent has replied that according to Memo no. 2052-9/48-2010/S (3) dated 12.05.2010 (Annexure 2) (issued by O/o Director, Education Department (Colleges), Punjab) Principal of the concerned College can grant leave to the part-time lecturer. Whereas this memo (Annexure 2) shows that Principal can issue No Objection Certificate to Mr. Bhupinder Singh (Part-Time Lecturer) to go abroad during summer vacation (04.06.2010 to 18.07.2010). This has been mentioned in Annexure 3 also. This shows that the respondent has given false reply to paragraph 1-3.

3. Point no. 4 of the annexure 3 shows that Mr. Bhupinder Singh cannot apply for extension in leave from abroad, but he has been regularly applying for extension. I am also enclosing copies of his applications demanding for extension in leave as Annexure 4. Thus is again against the reply given to paragraph 1-3. Dr. Babita which appeared on behalf of respondent today has made verbal submission during hearing that college authority ha snot sanctioned leave of Mr. Bhupinder Singh, whereas copies of the leave applications received by college bear diary no. date, stamp and signature of the Principal, S.R. Govt. College for Women. I request you, kindly direct respondent to give written submission regarding this.

4. Point no. 7 of the annexure 3 states that Mr. Bhupinder Singh will be terminated if he does not return on expiry of his leave (04.06.2010 to 18.07.2010). I request you, kindly direct respondent to give reasons why no action has been initiated against Mr. Bhupinder Singh for his long absence from his duty.”

Sh. Chowdhry is advised to take up the matter with the higher competent authority for removal of his objections.

Seeing the merits of the case, therefore, it is hereby closed and disposed of.

This judgment shall dispose of two petitions viz. Civil Writ Petition No.12082 of 2008 titled `Sunila Sharma vs. The State of Punjab and Another and Civil Writ Petition No.11200 of 2008 titled `Dr. Khushpal Sandhu vs. The State of Punjab and Another as they involve similar questions of law and facts.

For exact reference, file of CWP No.12082 of 2008 is taken up.

This civil writ petition has been filed under Article 226/227 of the Constitution of India praying for issuance of a writ in the nature of mandamus directing the respondents to grant special leave to the petitioner for the
purpose of self employment as provided in Instructions issued by the State of Punjab on 8.5.2002 (Annexure P-1).

It has been brought out that the petitioner, while working as lecturer in Hindi subject in Government College for Women, Amritsar, applied for leave for going abroad to meet her husband. The leave was sanctioned from 1.7.2007 to 31.5.2011, vide Orders Annexure P-4 and P-5. However, on account of certain circumstances, the petitioner could not avail of leave.

Instructions, Annexure P-1, provide for grant of five years special leave to Government employees for the purpose of self employment. Certain conditions have been laid in Instructions and a person fulfilling the same could apply.

Be that as it may, the petitioner applied for five years special leave for the purpose of self employment under Instructions, Annexure P-1. The application was forwarded by the Office of Principal, S.R. Government College for Women, Amritsar to the Director, Education Department, Punjab, vide Communication dated
28.6.2008 (Annexure P-6). Leave has not been sanctioned hence the petition.

Learned counsel for the petitioner states that once instructions have been issued after a conscious decision had been taken at the level of Council of Ministers, the same could not have been denied at the Secretary level. Learned counsel states that the instructions are required to be applied uniformly and the petitioner is
entitled to sanction of leave.

Learned counsel for the respondents has drawn the attention of the Court towards Order passed by the Hon ble Supreme Court of India in Civil Appeal No.4532 of 2009 arising out of SLP(C) No.29265 of 2008, titled `State of Punjab and Others vs. Dr. Sanjay Kumar Bansal to contend that the issue has been addressed by the Hon ble Supreme Court of India. It has been held that such a policy adopted by the State does not confer any right on an employee.

I have considered the issue.

Exact reference is required to be made to judgment dated 16.7.2009 rendered by the Hon ble Supreme Court of India in Civil Appeal No.4532 of 2009 arising out of SLP(C) No.29265 of 2008, titled `State of Punjab and Others vs. Dr. Sanjay Kumar Bansal . Relevant portion reads as under:-

Leave granted.

The short question which arises for determination in this case is whether the High Court was right in directing the Administration to grant special leave of five years for self employment to the respondent on the ground of alleged discrimination in grant of such special leave to others and not to the respondent.

Special leave is not a matter of right vested in the employee. It depends on the administrative exigencies. In
the present case the respondent is working as a Medical Officer. He had applied for special leave for three years under the Scheme which is Annexure P-3 collectively in the Special Leave Petition Paper Book. We have gone through Annexure P-3. It merely categorizes employees who are entitled to apply for special leave and those who cannot apply for special leave. Such policy does not confer any right on the applicant to obtain special leave. On facts, the question of striking down the Order of Administration does not arise for the simple reason that in the counter the Administration has stated that shortage of doctors is one of reasons for not granting special leave. In our view these are matters which fall in the category of administrative
exigencies and this Court cannot sit in Appeal thereon. In the circumstances, the High Court had erred in coming to the conclusion that the Management had erred in refusing the application for want of reasons.

Even on the case of discrimination it is for the Administration/Management to take into account the
contingencies which may arise in the course of administration. The services of an employee may be required in a given case on more emergent basis vis- a-vis other employees. In such cases the services rendered by an
employee, his seniority, the nature of work which he is required to do, his responsibilities etc. are required to be taken into account while taking decision on such applications. Lastly, it may be stated that in the Original
Writ Petition, factual malafides have not been pleaded by the respondent.

In the circumstances, we set aside the impugned judgment of the High Court. The Civil Appeal stands
allowed with no order as to costs.

Considering the issue raised in this petition, I find that earlier the petitioner had applied for leave (not under the policy adopted by the State). The leave was granted to the petitioner, however, she did not avail of the
leave. The petitioner after a lapse 11 months, applied for leave under Instructions (Annexure P-1) for five years for the purpose of self employment. The same has not been sanctioned.

Taking a cue from the judgment of Hon ble Supreme Court of India, I am of the considered opinion that no direction can be issued to the respondents to sanction leave to the petitioner in terms of the policy, decision
being in the domain of administrative functions.It is for the respondents to consider administrative exigency to grant leave or reject the application. Court in writ jurisdiction cannot sit in appeal over a decision taken in
administrative exigency. It is for the respondent employer to consider the feasibility of granting leave for a long period. Various aspects such as total number of employees working in the cadre, whether an employee can be spared for long period, the post an employee is holding, and other related facts are required to be
considered. The decision being within the domain of the respondents, the Court would not ordinarily substitute its own opinion. No such circumstances have been shown on behalf of the petitioner which would call for judicial review of the decision taken by the respondents.

In view of the above, I find no merit in the petitions.

The writ petitions are dismissed.

NAAC report of SR Government College for Women

Section I : Introduction

The Sarup Rani Government College for Women, Rani ka bagh, Amritsar (Punjab), was established in 1932 as Stratford College and got recognition from the UGC under 2(f) and 12(B) since the beginning. It was dedicated to Sarup Rani, mother of Pt. Jawahar Lal Nehru in 1976 to commemorate the International Women Year. Affiliated to G.N.D. University, it is an urban and rural based institution with a sprawling Campus covering 14.62 acres. The College has 23 departments covering the faculty of Arts, Science, Commerce and Home Science. The Faculty of Arts comprises seventeen departments. The Faculty of Science has five and regular Commerce course. The College offers three programmes at postgraduate level. The institution has Honours Courses in five Arts subjects and has four useful Vocational Courses. Out of 93 teachers, 83 are permanent teachers, 8 are part-time teachers and remaining 2 are the guest faculty. One holds D.Litt. Degree, 29 are Ph.Ds., and 30 are M.Phils. The College is efficiently run with the help of 38 members of administrative and technical staff (Administrative 9 and Technical 28). Besides there are gardeners, watchmen, sweepers and peons - 22 in all. The students enrolled in these courses are 2345, all from the same state. Enrolment in the Vocational Courses is 194 while 50 students have been admitted to the Certificate Course. Student enrolment in PG Diploma is 10 while in Music and Geography are 51. The percentage of success rate at the undergraduate level has been 95.4 and 98.7 in 2001-2002 and 2002-2003, respectively, which is quite impressive. At P.G. level the success rate is still higher. The Drop out rate is within 5%. During 2003-2004, 52 students got merit positions in the university examinations.

The College has Annual system of examination. On the support services side, the College has a Central Library, Computer Center, Sports facilities, Canteen, Cafeteria, Grievances Redressal mechanism and Vehicle parking space. This infrastructure is quite reasonable.

The S.R. Government College for Women, Amritsar volunteered to be assessed by the National Assessment and Accreditation Council by submitting their Self-Study Report in the month of December 2003. National Assessment and Accreditation Council constituted an Expert Committee to visit the College and validate its self-study report. The Peer Team comprises Prof. L.S. Rathore, Former Vice-Chancellor, Jai Narain Vyas University, Jodhpur as Chairperson,
Professor C.S. Mathela, Head, Chemistry Department, Kumaun University, Member Coordinator and Dr. Vijaya Chouhan, Former Principal, Government M.H. College, Jabalpur as member. The Peer Team carefully perused and analyzed the self-study report submitted by the College. During visit of the institution, Peer Team went through the relevant documents, visited the departments and facilities and interacted with its various constituents. The academic, co-curricular, sports and other facilities of the institution were also visited. The Peer Team interacted at length with the Principal, teaching faculty, students, non-teaching staff, parents and alumni of the institution. Based on the above exercise and keeping in mind the criteria identified by the National Assessment and Accreditation Council, the observations of the team are recorded in the following sections of the report.

Section 2: Criterion-wise Analysis

Criterion 1: Curricular Aspects
The college offers mainly three programmes – under graduate, post-graduate, and vocational. The students are admitted on the basis of merit. At under graduate level, the courses are B.A., B.Sc. and B.Com. In B.A. eighteen optional subjects are available – English, Punjabi, Hindi, Sanskrit, Maths, Geography, Political Science, Philosophy, Psychology, Sociology, Fine Arts, Music (Instrumental and Vocal), Dance, Economics and Physical Education, History, Home Science. In B.Sc. the subjects available are Physics, Chemistry, Botany, Zoology, Mathematics and Home Science. In addition there is a regular B.Com. course.

At post-graduate level the courses offered are M.A. in Music (Instrumental and Vocal) and Geography. In addition there is P.G Diploma in Nutrition and Dietetics.

The college offers vocational courses in Functional English, Functional Hindi, Office Management and Clinical Nutrition and Dietetics. The college has an impressive record of vocational courses.

The curriculum is designed by the university through its board of studies, where the 15 teachers of the college are represented in subjects concerned; and one is a member of university Senate as per its rules. It takes one year to introduce new courses.

During the last three years, the college has introduced three courses, namely, P.G. Diploma in Nutrition and Dietetics, Functional Hindi and Honors in Political Science.

The Functional English is designed to enhance the communication skill of the students. Its other peculiarities are job training (within one month) in local industry, counseling, desk officer work, sales promotion job and so on.

Criterion II: Teaching, Learning and Evaluation
The admissions are made on merit basis at undergraduate first year as per university norms. The appointments of teachers are made by the State Government through Public Service Commission. There is a desirable emphasis upon co-curricular activities. Students progression is properly evaluated having the provision of continuous internal evaluation through monthly and periodic tests. The college assesses student’s knowledge and skills through tests, quiz-contests, speeches, painting and talent - finding competitions. The college has managed Computer Education Center to provide Computer literacy to the students through APTECH Courses of the State Government. The study tours and academic discussions are the highlights of the co-curricular activities. Some of the faculties are using Audio Visual Aids and Computers for teaching.

The total working days of the college are 240 approximately; and teaching days are around 150. The workload of the teachers is 24 periods per week (of 45 minutes each). The ratio of full time teachers to part time teachers is 9:1. The ratio of teaching staff to non-teaching staff is 1.5:1; and the percentage of the classes by full time teachers is 90.

During 2003-04, four teachers participated in National seminars, 2 at International level and 2 have acted as resource persons.

The college has organized the ‘Fourth Punjab Geographers Conference’ in November, 2003. The teachers have actively taken part in Refresher Courses during the last two or three years – 33 teachers attended Refresher Courses and 2 have attended Orientation Courses. Four teachers have received the State/National awards.

The college has total Teaching Staff of 93 (including guest faculty), of which 28 teachers have Ph.D., one D. Litt. and 30 possess M. Phil. degree.

Criterion III : Research, Consultancy and Extension
A few departments strive to promote research culture among faculty though it is not the major activity in several departments.

The students are encouraged to participate in co-curricular and extension activities. Various extension activities like Community Development, social work, Health and Hygiene awareness, AIDS awareness, blood donation camp, Environment Awareness, National Integration activities are part of student activities being done by the students. The students are actively involved in various activities of NSS. The achievements of students of this college in sports and cultural activities at State and National level deserve high appreciation. In the Zonal and Inter-zonal Youth Festivals of GNDU and National Youth Festivals the students have brought laurels to the college. The college secured the first prize in Youth Festival among govt. colleges in 2003-04. The faculty of department of Physical Education has achievements to their credit and have been members of various state and national sports bodies. In Basket ball Dr. Suman Sharma got the Arjun Award and Maharaja Ranjit Singh Award. During 2002-2004, 6 Gold Medals in National, Inter-varsity, State and Inter College competitions were brought in Judo. In Athletics 7 Gold medals were won by its students. One, Ms. Harpreet was adjudged as the best athlete in the University and State. Chess, Taekundo, Wrestling and Badminton also brought Championships to the College. The college has NCC with an enrolment of 120, two of its students participated in Republic Day Camp in 2004. Naval NCC cadets, Ms Nargis Bamra, participated in Youth Exchange Programme in Singapore in May-June 2004. One of the cadets was adjudged the best cadet at ‘Pre Nau Sainik Camp’ in 2003 and the college NCC unit was selected as the best in Intra Battalion Competition held in 2004. The NSS has two units with enrolment of 250 students. The NSS has been active and its participation in various social activities has been commendable. The NSS has been judged as the best among the Government Colleges of the University. At present, three teachers are engaged in research work. During the last five years, 6 teachers have been awarded Ph.D’s degree.

Criterion IV: Infrastructure and Learning Resources
The College maintains its infrastructure like buildings, auditorium, playground, water supply, power supply, generator, P.C.O., furniture, library and laboratories. It makes use of the infrastructure to the optimum and also encourages use of the available infrastructure by external agencies.
The College has well-stacked library, which is run by an Advisory Committee. The total Number of books in the library are 40379. Books are regularly purchased and Stock verification is done annually. It has reference section and reading rooms with a seating capacity of about 100 students. The library is open 6 days a week from 9.00 a.m. to 4.00 p.m. The college has hostel facility for 200 students and all other amenities including the modern kitchen appliances are available for the students.
The college has 18 class rooms, 3 lecture theatres, staff room, common room and auditorium. The college has good play grounds : Volleyball, Basketball Court and Athletics track, etc. The institution has adequate physical facilities to run the educational programmes and administrative functions efficiently. The growth of the infrastructure keeps pace with the academic growth of the institution. The institution has effective mechanism for maintenance and optimal use of infrastructure.
The college has canteen facility for the students with a seating capacity of over 60 students. The college has also a Book Stall with stationery/text books catering to the needs of the students and two small Dispensaries with a permanent nurse and a part time Doctor who also attend the hostel inmates.

Criterion V: Student Support and Progression
The College collects feedback from the students. The College publishes updated Prospectus annually, which contains all information relating to admissions, fee structure, financial assistance etc.
Financial aid in the form of scholarships is given to the meritorious students. The needy students are also helped so as to encourage them to continue their studies.

The facilities available for the students are indoor games and outdoors games. College magazine, cultural programmes, subject societies, literary societies, health and nutrition education, dramatic club and dance-music competition are other positive features of the college.
The College offers academic counseling and placement services to its students. It arranges SSB Coaching Camps. The college has an Alumni Association, which is functioning well. Its alumni have been highly placed in different walks of life.

Criterion VI : Organization and Management
The college is governed by Government rules in the field of administration and finance; and its academic programs are governed by the decision of statutory committees of the G.N.D. University, Amritsar.

The college has adequate staff and the departments have adequate number of teaching staff – mostly permanent and appointed through state P.S.C. on the basis of U.G.C. norms. The manpower requirement has been adequately met and is fully utilized.

The king-pin in administration is the Principal, who is assisted by the various committees, towards the discharge of functions and responsibilities. In addition Principal is assisted by Bursar, Staff Council and Registrar.

The Grievance Redressal committee has been established lately.

The Teaching and non-teaching staff have loans facilities, such as,
building loan, vehicle loan, computer loan, G.P.F. loan etc. The purchase of major items is with the permission of the D.P.I. and through a purchase committee.

As per the policy of the Government, no tuition fee is charged from the under-graduate students. They have to pay other fees like library, laboratory, games and sports, examination, health, development, aid funds, etc., which comes to Rs. 294 per student. The fee structure is fairly low, and the college is advised to raise it slightly by persuading the Government so that development activities may be boosted up. The college is advised to find out the ways of exploiting information technology revolution to its fullest advantage for the benefit of the staff and the students.

The salaries of the staff and the teachers are paid by the Government. During 2002-03, the budgeted amount was Rs. 3,27,00,000, whereas the actuals have been Rs. 3,13,82,037. The budget is more or less balanced. There is no deficit. Out of the College fund the income for 2002-03 was Rs. 1302416; whereas the expenditure was Rs. 8,52,185 .

Auditing is done according to the Government procedures. The finances are properly managed by the college.

Criterion VII : Healthy Practices
The College is striving towards realizing the goals of imparting quality education and the following healthy practices have been established for this purpose :

*The college has adopted mechanism for internal quality checks.

*The teaching and non-teaching staff work together for the improvement of the institution. Their relationship seem to be harmonious.

*The social responsibilities are inculcated among the students through NCC, NSS and other student bodies; and their role have been effective.
*‘Chhatra Sabha’ (Student Association) actively supports institutional activities; and its working is highly satisfactory.

*The introduction of Functional English and Functional Hindi in the curriculum has been a novel feature and it has enhanced the communicational skills among the students.

*Under extension activities the Home Science department has under taken the ‘UTSAH’ project for under privileged students

*P.T.A. and other fund raising agencies are doing commendable job for the development of the college.

*The discipline in the college is excellent.

*The Red Cross Society of the college is doing well.

*The use of Internet for teaching in History is appreciable.

*The Principal addresses the students on the first day of the opening; the prayers are held on important occasions; and the dress code (once in a week) is being observed.

*The Campus is pollution free, and there are a good number of trees and lawns.

*The tenor and tone of academic life is well maintained.

Section 3: Overall Analysis
The S.R. Government College for Women, Amritsar has reasonably good infrastructure and a band of devoted and qualified teachers. The strong supporting systems on the campus like hostel, play grounds, canteen etc. provide for an atmosphere for quality education and personality development of the student. Adequate facility for games and sports have helped to create a sportsmanship spirit among the students.

The care, warmth and concern displayed by faculty towards the girls have significantly contributed towards the awareness of women empowerment. The college is maintaining its standard of education along with a high moral value system. To sum up, the college has succeeded in providing an educational environment.

The college gets the grants from the Government to meet the major items of the expenditure regarding the salaries of its staff and other benefits. Its other sources of income are through its Amalgamated fund, which is constituted out of the fee of the students, i.e., Rs. 96/- per annum, per student. The other source of income is through the discretionary funds, which is at the disposal of M.P. and M.L.A.

In view of the growing role of Information Technology, the college needs to establish its own Computer Center.

The college at present is having the vocational courses in Functional Hindi, Functional English, Office Management and Clinical Nutrition and Dietitics. These programs are running well. The college can think of starting more vocational courses.

The achievements of the students in the field of games and sports; in youth festivals; music and dance; N.C.C and N.S.S have been excellent. The students have secured a good number of prizes in these fields. Added to this, the academic achievements of the students have been praiseworthy.

The faculty of the college is fairly dedicated to its job but it should also strive to promote research and publications. The department of Punjabi has a good number of publications to its credit.
While commending the College for the good work it has done, the Peer Team would like to make the following suggestions for its future growth and further development:

There is a need for starting more career-oriented courses such as Mass Communication and Journalism, Tourism, Information Technology, Computer Sciences and Fashion Designing.

Postgraduate courses in Dance, Fine Arts, Commerce, Chemistry and M.C.A. may be started.

The College may further strengthen the Language Laboratory, so as to make the students proficient in communication and personality development.

Coaching classes for competitive examinations may be provided to the students.

The laboratories of the Science Faculty need improvement. The additional funds may be provided for this purpose.

The computerization of the library may be done on priority. The college should subscribe further to standard journals and periodicals for library.

Internet facilities may be provided in library and staff room.

Teachers should have greater academic liaison with other institutions of the region and may apply for grants for funding for research projects.

The college may consider the possibility of setting up an Internal Quality Assurance Cell (IQAC) to help the institution.
