This revision petition is directed against the order dated
17.05.2010 passed by the learned Rent Controller, Kaithal by which an application filed by the petitioner under Order 9 Rule 13 of the Code of Civil Procedure, 1908 [for short “CPC”] for setting aside the ex-parte order dated 15.01.2010, has been dismissed.
In brief, the respondent/landlord filed a petition under Section 13 of the Haryana Urban (Control of Rent and Eviction) Act, 1973 [for short “the Act”] for eviction of the petitioner/tenant from the demised premises on the grounds of non-payment of rent, subletting and personal necessity. As per the zimni orders produced on record, the petition was filed on 21.08.2009 and the following order was passed on that date: -
Petition presented today. It be checked and registered.
Now, notice of its petition be issued to the respondent for 30.10.2009 on filing of PF etc.
The said notice could not be served upon the petitioner/tenant as there was a report of “Gair Abad” which means that nobody is residing at the said address. Hence, on 30.10.2009, following order was passed: -
Notice issued to the respondent received back with the report of Gairbad. Fresh notice be issued for 10.11.2009 on filing of correct address. Dasti process be given so desired.
On 10.11.2009, following order was passed:-
Notice issued to the respondent received back unexecuted. Fresh notice to respondent be issued for 03.12.2009 on filing of summon and copy etc.
On 03.12.2009, following order was passed: -
Summon and copy not field. On the request, adjourned to 15.12.2009 for service of respondent on filing of summon form and copy etc.
On 15.12.2009, the Court was on leave, therefore, the case was taken up on 12.12.2009 and was adjourned to 15.01.2010. On that date, the following order was passed: -
Munadi received back duly effected but none has come present on behalf of respondent despite repeated calls.
It is 3.00 p.m. Waited sufficiently. So, respondent is proceeded ex-parte. Now, to come up on 06.02.2010 for ex-parte evidence.
After the aforesaid order was passed on 15.01.2010, the application was filed by the petitioner for setting aside the ex-parte proceedings which has been dismissed vide the impugned order.
Learned counsel for the petitioner submits that there is no order on record from which it could transpire that the Court had directed the service upon the petitioner by way of munadi, rather it is submitted that on 30.10.2009 the learned Rent Controller recorded that notice issued in the ordinary course
could not be served upon the petitioner and was received back with the report of “Gair Abad” and fresh notice was ordered to be issued on filing of correct address. However, no correct address was provided by the respondent/landlord, meaning thereby the said address remained on the record for the purpose of service upon the petitioner.
Learned counsel for the respondent is very candid and fair to
concede that there is no order on record from which it could be made out that the service by way of munadi was ordered.
In view thereof, the impugned order is patently erroneous as it runs contrary to the zimni orders having been passed by the learned Rent Controller.
Thus, the present revision petition is allowed, the impugned order is set aside and the petitioner is allowed to join the proceedings from the stage he was ordered to be proceeded against ex-parte.

NCTE appeal order for RKSD College of Education KaithalF.No.89-773-2010-Appeal
NATIONAL COUNCIL FOR TEACHER EDUCATION

O R D E R
WHEREAS the appeal of R.K.S.D. College of Education, Kaithal, Haryana dated 24-06-2010 is against the Order No. F.NRC-NCTE-F-3-HR-289-2010-24159-24166 dated 23-06-2010 of the Northern Regional Committee, withdrawing recognition for conducting B.Ed course on the grounds
1) For an intake of 200 B.Ed. students, only ten Faculty members have been appointed which is not as per NCTE norms B.Ed.
2) Regular Principal has not been appointed.
3) Ten computers are not sufficient for an intake of 200 B.Ed. students.
4) The classrooms are still small in size.
5) All labs are still ill equipped.”
AND WHEREAS the Correspondent, R.K.S.D. College of Education (hereinafter referred to as the appellant), preferred an appeal dated 28-06-2010 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order.
AND WHEREAS the appellant filed a petition before the Hon’ble Court of Civil Judge (JD), Kaithal, Haryana and the Hon’ble Civil Judge in his order dated 02-08-2010, taking into account the submission of the petitioner that if the appeal is not disposed of within this month, admission time will be over, directed the Council to dispose of the appeal well before the next date of hearing (21-08-2010).
AND WHEREAS Shri Subhash Mittal, President and Dr. S.K. Garg, Director (Planning), R.K.S.D. College of Education, Kaithal, Haryana presented the case of the appellant institution on 12-08-2010. In the appeal and during personal presentation it was submitted that they have since appointed four more lecturers and a Principal, their selections have been approved by the Kurukshetra University; the selected regular Principal has joined on 11-06-2010; a new ICT Resource is now equipped with 30 computers and all other requisite equipments; the college has sufficient building for intake of 200 students including four class rooms of proper size; and the college has re-organized all the labs as per the norms.
AND WHEREAS the Council noted that the institution was inspected u-s 17 of the NCTE Act on 20-09-2009; the inspection team found that only seven faculty members (lecturers) were in position; and in response to the Show Cause Notice dated 20-11-2009, the institution in their reply dated 18-11-2009 admitted even by that time they had only 10 lecturers and still deficient of teaching staff due to nonavailability of eligible candidates. Admittedly the institution took steps for appointment of further faculty members only after the inspection and the selection of the additional faculty took place only in June, 2010 and approval of appointments is still to be conveyed by the Kurukshetra University, Kurukshetra. The Council noted that the institution was initially granted recognition for an intake of 100 students vide NRC’s order dated 18-08-07 and subsequently recognition for an additional intake of 100 students was granted by NRC in their order dated 12-10-07. The Council taking into consideration that the faculty available at the time of inspection on 20-09-2009 was adequate only for one unit of 100 students and the additional faculty were not available when the NRC considered the case of the institution in their meeting held from 26th to 29th May, 2010 has come to the conclusion that the appeal deserved to be partially accepted, the order of the NRC withdrawing recognition for an intake of 200 students set aside and the NRC directed to continue recognition for the initial intake of 100 students and withdraw recognition for the additional intake of 100 students. NRC should issue these orders within 15 days of the issue of appellate order.
AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, VT Report and after considering oral arguments advanced during the hearing, the Council reached the conclusion that there was adequate ground to accept the appeal, set aside NRC’s order dated 23-06-10 and remand back the case to NRC with direction to continue recognition for the initial intake of 100 students and withdraw recognition for the additional intake of 100 students. NRC should issue these orders within 15 days of the issue of appellate order.
NOW THEREFORE, the Council hereby remands back the case of R.K.S.D. College of Education, Kaithal, Haryana to the NRC, NCTE, for necessary action as indicated above.

Defendant No.1-Northern Regional Committee, National Council for Teacher Education has invoked the jurisdiction of this Court under Article 227 of the Constitution of India to impugn order dated 10.09.2010 Annexure P-11 passed by learned Civil Judge (Junior Division), Kaithal thereby appointing Local Commission consisting of two Commissioners for inspecting the college being run by plaintiff-respondent Nos.1 and 2 and to report about the infrastructure available in the college for running Bachelor of Education Course. The Commissioners have been authorized to conduct videography and photography, if required. Assistance of draftsman may also be taken, if required.
Plaintiffs were running B.Ed. College with intake of 200 students, but on the basis of report of visiting team which inspected the college of plaintiffs on 20.09.2009, defendant No.1 de-recognised the college on the ground of lack of infrastructure. On appeal preferred by the plaintiff, defendant No.2-National Council for Teacher Education, New Delhi allowed appeal partly permitting intake of 100 students instead of 200 students. The plaintiffs have filed suit for mandatory injunction claiming various reliefs including intake of 200 students. Plaintiffs moved application for appointment of Local Commissioner to report about the infrastructure available in the college of the plaintiffs. The said application has been allowed by the trail Court by impugned order. I have heard learned counsel for the petitioner and perused the case file. Learned counsel for the petitioner contended that the Local Commissioners appointed by the trial Court include an Advocate and a member of the visiting team out of the list submitted by defendant No.1, but the Advocate has no expertise to report about the infrastructure requirement for running the B.Ed. College and it is the prerogative of defendant No.1 to appoint visiting team to report about the infrastructure available.
I have carefully considered the aforesaid contention, but find no merit therein. Admittedly there is dispute between the parties regarding the sufficiency of the infrastructure available with the college of the plaintiffs. In view thereof, it is imperative to obtain report of the infrastructure available in the college of the plaintiffs. Local Commissioners have, therefore, been rightly appointed by the trial Court to report about the availability of the said infrastructure. An Advocate may not be in expert from the angle of defendant No.1- petitioner, but an Advocate can certainly report about the availability of the accommodation, land and furniture etc. Moreover, videography and photography have also been permitted. Services of draftsman has also been permitted as per impugned order. In addition to it, the trial Court has taken precaution to include a member from the list of visiting team members, submitted by defendant No.1 as one of the two Local Commissioners. The said member, as per defendant No.1-petitioner, is an expert member and, therefore, the Commission can well be executed with aid of the said expert member. Appointment of Local Commissioners would not amount to collecting of evidence on behalf of plaintiffs as sought to be argued by counsel for the petitioner. On the contrary, when the quantum of infrastructure available in the college is in controversy, the only proper method is to appoint Local Commissioner to bring first hand information about the infrastructure availability at the spot. If the petitioner acts arbitrarily, the aggrieved party should have some remedy to assert its claim and since petitioner is asserting that infrastructure is inadequate and insufficient, the plaintiffs were left with no option but to seek appointment of Local Commissioner to report about the available infrastructure. For the reasons aforesaid, I find no illegality or jurisdictional error in the impugned order of the trial Court. The revision petition is completely misconceived and devoid of merit and is accordingly dismissed in limine.
