The Respondent states that this information was sent to the Complainant on 18.9.2009, but it has been returned back by stating that “no body of this name resides on that address in Ludhiana”. The Complainant has not appeared at the last hearing and same is the case today. It seems she is not interested in pursuing the case. I am satisfied with the reply given by the Respondent. It is advised that this information should be sent to the Complainant within a week’ time by registered post (A.D.). The Respondent states that this letter will be retained for six months and she can collect the same any time from the College.
Therefore, the case is hereby closed and disposed of.
Copies of the order be sent to both the parties.

The Complainant filed a complaint on 26.5.2009 that his original application dated 15.2.2009 has not been attended to.
The information sought by him is regarding “Verification report of her B.A.Degree from Magadh University, Bodh Gaya (Bihar) under Roll No.2286, Regd. No.94-KTS-115, Session: 1994-95 and copy of Migration Certificate.”
A letter has been sent by the Principal to the Complainant stating that “It is to inform you that in reference to your letter dated 2.4.2009; you have been issued Bachelor of Education Degree under Registration No.94-KTS-115 and Roll No.2286 by Punjab University, Chandigarh. The verification of the registration number will be done by Punjab University, Chandigarh. Kindly contact the University”.

The Complainant is not present today. Directions are given to the Complainant to get the verification of B.A.Degree and Registration Number from Magadh University done by the Punjab University.

Therefore, the case is fixed for further hearing on 30.10.2009 at 12:00 Noon in the Chamber.

The prayer made in this civil writ petition filed under Article 226/227 of the Constitution of India is for issuance of a writ in the nature of mandamus directing the respondents to comply with the directions given by Division Bench of this Court while dealing with Civil Writ Petition No.14340
of 2006 titled Arya College, Ludhiana Vs. State of Punjab and Others , decided on 18.12.2007.

It has been brought out that the petitioner is helping the State to achieve its welfare policies. The State of Punjab implemented a scheme known as `95% Deficit Grant in Aid Schee for granting financial assistance to non government aided colleges. The State Government took a conscious decision to provide financial assistance to private aided colleges to enable these colleges to pay the scales recommended by the UGC so as to maintain minimum standards in higher education on
the basis of sanctioned strength of teaching and non teaching employees. Because the respondents are not releasing the admissible grant in aid, the petitioner is unable to pay the teaching and non
teaching staff which seriously hampers the working of the Institution.

Issue notice of motion.
Mr. Anil Sharma, Senior Deputy Advocate General, Punjab, on the asking of the Court, accepts notice. Copy of the petition has been handed over.

Heard.
Learned counsel for the respondents has not been able to dispute that grant in aid is required to be released in terms of the judgment relied upon on behalf of the petitioner.

I have considered the issue. The Division Bench in the case of Arya College, Ludhiana (supra),
issued directions in the following terms:-

Accordingly, we direct the State to meet its liability as per its declared scheme within three months from today.

The State will be at liberty to rely upon the record already available or to have access to such other record of the petitioner-college as, may be necessary, but on this account, the State will not avoid its liability. We make it clear that Secretary, Higher Education, Punjab will be held personally liable in case of default in meeting the liability.

This Court has considered the very issue while dealing with Civil Writ Petition No.4464 of 2009
titled BLM Girls College, Arya Samaj, Nawanshahr vs. State of Punjab and Others , decided on 21.3.2009 and Civil Writ Petition No.5393 of 2008, titled Ramgaria College of Education, Phagwara vs. State of Punjab and Others , decided on 24.4.2008, in which also the respondent-State has been directed to release the grant in aid.

In Civil Writ Petition No.3191 of 2007 titled `The Managing Committee, Guru Gobind Singh College, Saghera, Barnala, District Sangrur vs. State of Punjab and Another decided on 19.2.2008, similar view has been taken and direction was issued to the respondents to release grant in aid.

Special Leave Petition was filed by the State of Punjab, the same being SLP No.15798 of 2008 which was dismissed on 8.12.2008.

Considering the directions issued by this Court in various cases as noticed above, and in the facts and circumstances of this case, it is directed that the respondents shall pay 85% of the grant-in-aid due to the petitioner within a period of 4 months after clearance of objections by the petitioner.

So far as balance 15% of the amount of grant-in-aid due is concerned, the petitioner may submit separate representation to the respondents.

Petition is allowed in the above terms.

Degrees conferred on 232 students

Dr S.S. Johal, Vice-Chairman, Punjab State Planning Board, and former Vice-Chancellor, Punjabi University, Patiala, has urged teachers of the state to inculcate nationalistic and humanistic values in their students.

He said this while addressing outgoing students of Khalsa College for Women and GHG Harparkash College of Education for Women at the annual convocation here today.

Underlining the significance of alma mater in individual’s life, Dr Johal claimed that the knowledge and training received through teachers was the most vital resource in one’s life.

He said education was a treasure that could neither be stolen nor destroyed.

On the role of teachers in restructuring modern society, Dr Johal said the educator was the builder of a nation. “Besides enabling us earn our livelihood, a teacher acts as a torchbearer and directs us the right path in the darkness of ignorance,” maintained Dr Johal.

He also conferred graduation and post-graduation degrees on 232 girls.

Dr Kanwaljit Kaur Gill, college Principal, lauded the role of lecturers and other staff of the institute who, according to her, had dedicated themselves to the cause of education.

“Passion and perseverance, the fundamental qualities of a teacher were certainly more prevalent in women than in men,” claimed Dr Gill.

The organisers conferred roll of honour on four students of the college who had retained top positions in the university examination. While Swippan Deep Kaur topped in MEd examination conducted by Panjab University, Chandigarh, last year, Sunita Malhotra and Puneet Sharma bagged third and eight positions, respectively.

Narinder Kaur retained second position in BEd examination of Panjab University.

A cultural programme and a party was arranged on the college premises last night.

The constituents of the college, including staff and managing committee members, wished the girls a bright future.
