Khalsa College for Women, Civil Lines, Ludhiana, has approached this Court in its writ jurisdiction for issuance of a writ in the nature of mandamus seeking a direction to the respondents to release the due grant-in-aid as admissible to the petitioner to enable the petitioner-College to disburse the same to the teaching and non-teaching employees employed under grant-in-aid scheme.

Learned counsel for the petitioner contends that similar issue was raised in C.W.P. No.14340 of 2006, titled ‘Arya College, Ludhiana Vs. State of Punjab and others’ dated 18.12.2007, which was allowed with certain directions as is evident from the judgment (Annexure P-8).

Notice of motion. Mr. K.S. Dadwal, Additional Advocate General, Punjab, on the asking of the Court, accepts notice on behalf of the respondents. Copy of the petition has been given. Learned counsel for the respondents has not been able to dispute that the grant-in-aid is required to be released in terms of judgment relied upon on behalf of the petitioner. Considering the facts and circumstances of the case; in terms of judgment rendered in Arya College’s case (supra) and decision rendered in C.W.P. No.5393 of 2008, decided on 24.4.2008, in case titled ‘Ramgaria College of Education, Phagwara vs. State of Punjab and others’, it is directed that the respondents shall pay 85% of the grant-in-aid due to the petitioner within a period of 3 months after clearance of objections by the petitioner. So far as balance 15% of the amount of grant-in-aid is concerned, the petitioner may submit separate representations to the respondents. Petition is allowed in the above terms.

The petitioner, who had retired from the services of Khalsa College for Women, Ludhiana as Lecturer in English on 30.11.1998 on attaining the age of superannuation, has filed the instant petition for issuing direction to the respondents to pay her full retiral benefits, such as gratuity,
provident fund, leave encashment etc. along with interest, which till date have not been paid to her.

Admittedly, earlier the petitioner had filed CWP 1025 of 2003 for the same relief. The said writ petition was disposed of by this Court vide order dated February 13, 2003 while directing the Managing Committee of the said College to take a final decision on the representation dated 23.12.2002 filed by the petitioner regarding the claim of unpaid gratuity, leave encashment, contributory provident fund etc. In pursuance of the said order, respondent No.3 passed a speaking order dated 20.5.2003 and released certain payments which were found due to the petitioner towards the retiral benefits. Thereafter, the petitioner remained silent for four years and again in the year 2007 she made another representation and after two years of the said representation, she has filed the instant petition.

Undisputedly, when the earlier representation was decided and the claim of the petitioner with regard to retiral benefits was determined vide speaking order dated 20.7.2003, the petitioner did not challenge the said order. Now after six years of the said order, the petitioner claimed that some of the retiral benefits have not been fully paid to her. In view of these facts, in my opinion, the second petition for the same relief does not require to be entertained in exercise of the writ jurisdiction of this Court.

Dismissed.

In view of the aforesaid stand taken by learned counsel for the respondent, I am not inclined to proceed further in this petition.

Rule discharged.

However, the respondents shall bound by the aforesaid assurance given before the Court.
