O R D E R

WHEREAS the appeal of Om Budheshwar Nath R.S.V.S. Mahavidyalaya, Pratapganj , Uttar Pradesh dated 25-03-2010 is against the Order No. F.NRC-NCTE-F- 3-UP-3144-156 Meeting-2010-18064 dated 08-03-2010 of the Northern Regional Committee, refusing recognition for conducting B.Ed course on the ground “The Faculty has not been appointed through duly constituted selection committee as per NCTE norms.”

AND WHEREAS the Correspondent, Om Budheshwar Nath R.S.V.S. Mahavidyalaya (hereinafter referred to as the appellant), preferred an appeal dated 25-03-2010 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order.

AND WHEREAS Dr. Arvind Kumar Misra, Adviser and Shri Shashi Prakash Singh, member, Om Budheshwar Nath R.S.V.S. Mahavidyalaya, Pratapganj, Uttar Pradesh presented the case of the appellant institution on 22.04.10. In the appeal and during personal presentation, it was submitted that the duly constituted selection committee recommended four lecturers of the subject pointed out by the NRC - (i) Shri Sarvesh Pratap Singh (Physics) (ii). Km. Anuradha Singh (Mathematics) (iii) Shri Yogesh Kumar Singh (Botany) (iv) Shri Deepak Singh (Physical Education). The reason for refusing recognition to the appellant institution by NRC was perhaps due to calling the same selection committee constituted by the affiliating university vide
letter dated 21-10-2009 on the subsequent occasion also, instead of constituting the same afresh. The NRC erred in deciding the case of the appellant institution as there was a reference no. RMLAV-affiliation-AF-227(2)-2010-17901 dated 19-03-2010 issued by the affiliating university clearly mentioning that the subject expert(s) for selecting faculty members for the appellant institution, as nominated by the university earlier, instead of constituting the same afresh vide letter dated 21-10-2009 would remain the same till the finalization-approval of the faculty of the appellant institution. On having followed the above guidelines, of the affiliating university, the appellant institution had called the same selection committee on the subsequent occasion for selecting the remaining lecturers for the institution.

AND WHEREAS the Council noted that reply to letter of intent prior to recognition dated 30-10-2009 was submitted by the institution alongwith documents regarding staff vide letter dated 04-11-2009. Subsequently, further information sought regarding removal of deficiencies namely (i) website had not been developed as per NCTE norms and (ii) there was no staff to teach methods of teaching Mathematics, Physical Science and Biological Science by the NRC’s letter dated 17-12-2009 was also furnished by letters dated 05.02.2010 and 09-02-2010.

The Council verified the faculty profile submitted by the institution and the same was found to be in order. Therefore, the Council was of the view that there was adequate justification for accepting the appeal, for issuance of formal recognition order.

AND WHEREAS the decision of the Council cannot be implemented immediately in view of the NCTE’s Public Notice dated 28-07-09, announcing the general policy of the NCTE not to further recognise any teacher training institution in the state of Uttar Pradesh for the B. Ed. course during the 2010-11. Since that has been done as a temporary measure for a period of one year only, in order to regulate the growth of teacher education in the State and the same is to be
reviewed for forthcoming years, the Council therefore decided that the formal recognition order be issued under clause 7(11) of the NCTE Regulations, 2009 immediately to the institution, but its operation shall be effective from the date of lifting of the said general ban orders.

AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, VT report and after considering oral arguments advanced during the hearing, the Council came to the conclusion that there is adequate ground to accept the appeal and set-aside NRC’s order 08.03.10 and remand back the case to NRC for issuance of formal recognition order under clause 7(11) of the NCTE Regulations 2009 immediately. The decision of the Council would, however, be operative from the date of withdrawal of the ban on further recognition of B.Ed.
course in the State of Uttar Pradesh.

NOW THEREFORE, the Council hereby remands back the case of Om Budheshwar Nath R.S.V.S. Mahavidyalaya, Pratapganj , Uttar Pradesh to the NRC, NCTE, for necessary action as indicated above.
