NCTE appeal order for Sri Gulab Singh Mahavidyalaya Barmupur

O R D E R

WHEREAS the appeal of Shri Gulab Singh Mahavidyalaya, Auraiya, Uttar Pradesh dated 26-04-2010 is against the Order No. F.NRC-NCTE-F-3-NRCAPP28-157th Meeting-2010-19692 dated 12-04-2010 of the Northern Regional Committee, refusing recognition for conducting D.Ed. course on the grounds

1) Land document is not certified.

2) Notarized CLU is not submitted.”

AND WHEREAS the Correspondent, Shri Gulab Singh Mahavidyalaya (hereinafter referred to as the appellant), preferred an appeal dated 27-04-2010 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order.

AND WHEREAS Shri Sheelendra Singh, Typist and Shri Haridarshan Singh, Typist, Shri Gulab Singh Mahavidyalaya, Auraiya, Uttar Pradesh presented the case of the appellant institution on 20.05.2010. In the appeal and during personal presentation, it was submitted that land document duly certified by the Sub-Registrar was submitted to NRC and the NRC did not ask the institution to furnish notarized CLU but nonnotarized CLU was submitted.

AND WHEREAS the Council noted that the NRC had issued a deficiency letter dated 22.12.2009, inter-alia, pointing out the deficiencies that (i) land documents submitted indicated that the land was not in a single plot, it appeared that land was
in different places and the land document was also not certified and (ii) the land usage certificate submitted had not been issued by the competent Government authority. Alongwith the reply of the institution dated 19.01.2010, it furnished the requisite documents to the NRC. Therefore, the Council was of the view that there was adequate ground to accept the appeal and set-aside the NRC’s order dated 12.04.2010 with direction to the NRC for further processing the case on merit.

AND WHEREAS after perusal of documents, memorandum of appeal, affidavit and after considering oral arguments advanced during the hearing, the Council reached the conclusion that there was enough ground to accept the appeal and set-aside the NRC’s order dated 12.04.2010. Accordingly, the appeal was accepted and the NRC’s order was set-aside and the case was remanded to NRC for further processing of the case on merit.

NOW THEREFORE, the Council hereby remands back the case of Shri Gulab Singh Mahavidyalaya, Auraiya, Uttar Pradesh to the NRC, NCTE, for necessary action as indicated above.
