O R D E R

WHEREAS the appeal of R.I.E.T Vidyapeeth, Meerut, Uttar Pradesh dated
07-06-2010 is against the Order No. NRC-NCTE-F-3-NRCAPP102-157
Meeting-2010-20374 dated 16-04-2010 of the Northern Regional Committee, refusing recognition for conducting D.El.Ed course on the grounds “1) Land document is not certified. 2) Three academic sessions of running B.Ed. course have not been completed. 3) CLU is for khasra number 1686 and 1687 where as only 1687 khasra number is mentioned in the land document. 4) Total built area is not mentioned in the building plan. 5) Original FDRs of Rs. 3 lakh and Rs. 5 lakh are not submitted.”

AND WHEREAS the Correspondent, R.I.E.T Vidyapeeth (hereinafter referred to as the appellant), preferred an appeal dated 08-06-2010 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order.

AND WHEREAS Sh. Amit Giri, Chairman and Sh. Ankur Aggarwal, Director, R.I.E.T Vidyapeeth, Meerut, Uttar Pradesh presented the case of the appellant institution on 16-08-2010. In the appeal and during personal presentation it was submitted that the land documents were certified by the Public Notary, Govt. of India, which is a competent authority; there is no question of running three academic sessions of B.Ed which was recognized on 31.08.2009 as 2009-10 session was declared as zero session
by the Govt. of UP and consequently no existing course was being run at the time of applying for D.El.Ed. Course; as the institution has 4810 sq.mts in Khasra No. 1687 and 650 Sq. mts in Khasra No. 1686, they obtained CLU for both Khasras for their future planning; a total built up area of 3038 sq. mts was shown in the building plan; and FDRs for Rs. 5 lakhs dt. 2.09.2009 and Rs. 3 lakhs dt. 8.10.2009 have already been submitted with the application.

AND WHEREAS the Council noted that in accordance with the provisions of the NCTE Regulations, only a certified copy of the registered land document issued by the competent authority is acceptable and therefore a notary attested document as true copy was not acceptable. The Council also noted that the built up area indicated in the earlier building plan prepared by a different architect was 2577 Sq. mts. whereas in the building plan, furnished along with the reply to the deficiency letter which was prepared by another Architect, the built up area was shown as 3038.38 Sq. mts. The Council found that the two FDRs have been furnished along with the application on 24.10.2009. The Council further noted that the B.Ed course having been recognized on 31.08.2009, the provisions of clause 8(3) of the NCTE Regulations, namely, requirement of completion of three academic sessions before applying for an additional course apply irrespective of the fact that the institution has not been able to run some academic sessions after grant of recognition for one reason or the other. The Council taking into account all aspects of the matter came to the conclusion that the NRC was justified in closing the file and, therefore, the appeal deserved to be rejected and the order of the NRC confirmed.

AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, and after considering oral arguments advanced during hearing, the Council reached the conclusion that there was no ground to accept the appeal and hence it should be rejected. Accordingly, the appeal was rejected and NRC’s order dated 16-04-10 was confirmed.

NOW THEREFORE, the Council hereby confirms the Order appealed against.
