O R D E R

WHEREAS the appeal of Global College of Higher Education (Dilraj Singh Memorial Educational Society), Mansa, Punjab dated 05-02-2010 is against the Order No. F.NRC-NCTE-F-7-PB-672-154th Meeting-2010-15183 dated 19-01-2010 of the Northern Regional Committee, refusing recognition for conducting B.Ed course on the ground “The Management did not allow the VT members to inspect the infrastructure and instructional facilities on 19 or 20 October, 2009”.

AND WHEREAS the Correspondent, Global College of Higher Education (Dilraj Singh Memorial Educational Society) (hereinafter referred to as the appellant), preferred an appeal dated 05-02-2010 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order.

AND WHEREAS Shri. Gagandeep Singh, Vice-Chairman, Global College of Higher Education (Dilraj Singh Memorial Educational Society), Mansa, Punjab presented the case of the appellant institution on 16.3.2010. In the appeal and during personal presentation it was submitted that on 15.10.2009 the college received a phone call and letter on 17.10.2009 from NRC regarding inspection of college during the period between 18 to 22 October, 2009 under section 14(1) of NCTE Act. In response to that letter, the Vice-President of Global College of Higher Education vide letter dated 16.10.2009 informed the NRC that staff of institution were on leave till 21.10.2009 due to Diwali and Vishwakarma holidays and requested for an alternate date for inspection after 22.10.2009. But ignoring that intimation, the NRC sent a team to inspect the college on 19 and 20th October, 2009 and recognition to the institution was refused on the ground that the management did not allow the VT members to inspect the institution on 19-20th October, 2009.

AND WHEREAS the Council noted that initially the NRC had closed the file of the institution vide order dated 2.6.2009 on the ground that the institution had not furnished CLU from competent authority, the building plan submitted did not indicate built up area and total area and resolution of the Gram Panchayat was not submitted. An appeal dated 26.6.2009 of the institution against closure of its case by the NRC was considered by the Council and the case was remanded to the NRC for getting the institution inspected immediately, vide council’s order dated 7.8.09.

Accordingly, the NRC constituted a Visiting Team of Experts to inspect the institution as also a few other institutions during the period from 18 to 22 October, 2009 and the visiting team contacted the institution thrice for conducting inspection either on 19
or 20th October, 2009 but the institution categorically refused to get inspection on 19 or 20th October, 2009 suggested by the team. The Council also noted that the application of the institution was for recognition of a new course and therefore, the plea of the institution for postponement of inspection on the ground that it was having staff who would be on leave till 21.10.2009 was untenable. Further, the inspection was for verifying availability of infrastructure and other facilities with the institution and therefore there was no need for the presence of the staff even if staff were employed by the institution. Therefore, the Council was of the view that the recognition was refused to the institution by the NRC for valid reasons and, therefore, there was no ground to accept the appeal.

AND WHEREAS after perusal of documents, memorandum of appeal, affidavit and after considering oral arguments advanced during hearing, the Council reached the conclusion that there was no ground to accept the appeal and that it should be rejected. Accordingly, the appeal was rejected and NRC’s order dated 19-01-10 was confirmed.

NOW THEREFORE, the Council hereby confirms the Order appealed against.

O R D E R

WHEREAS the appeal of Global College of Higher Education, Mansa, Punjab dated 26-06-2009 is against the Order No. NRC-NCTE-F-7-PB-672-140 MEETING-2009-3499 dated 02-06-2009 of the Northern Regional Committee, refusing recognition for conducting B.Ed course on the grounds 1) CLU from competent authority is not submitted. 2) Building plan does not indicate built up and total area.
3) Gram Panchayat resolution is not submitted.

AND WHEREAS the Correspondent, Global College of Higher Education(hereinafter referred to as the appellant), preferred an appeal dated 26-06-2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order.

AND WHEREAS Shri Gagan Deep Singh, Vice-President, Global College of Higher Education, Mansa, Punjab presented the case of the appellant institution on 25-07-09. In the appeal and during personal presentation it was submitted that the appellant had removed the deficiencies vide its letter dt 23.04.09 by submittingapproved building plan indicating total area, builtup area and Kh. No. etc, Land area certificate, Building completion certificate etc. It also filed an affidavit before NRC on 21.04.09 stating that the appellant was in possession of 5 acre of land and 1810 sq. ft. of builtup area for the proposed B.Ed programme.

AND WHEREAS the Council noted that NRC vide its deficiency letter dt 04.02.09 informed the institution to submit building plan indicating area and kh no. details; CLU from revenue department; Building completion certificate etc; The institution submitted its reply to this deficiency letter on 23.04.09 and this was received by NRC on 24.04.09, that was well in advance of the scheduled NRCs meeting on 25-26th April09. It also noted that the institution on 23.04.09 along with its reply submitted approved building plan indicating total area details, land area certificate issued by Tehsildar, Mausa and the reply was received by NRC office on 24.04.09, much before the schedule date of NRCs 140th meeting held on 25-26th April 09. In view of the above the Council came to the conclusion that there was enough justification in accepting to appeal to be remanded the case to NRC for causing inspection of the institution and there after pass appropriate orders.

AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, and after hearing oral arguments advanced during the hearing, the Council reached the conclusion that the institution should be got inspected to ascertain availability of necessary infrastructure, instructional and other facilities in accordance with the norms prescribed by the NCTE to become eligible for recognition by NCTE. Accordingly, the case was remanded back to the NRC for inspection of the Institution immediately and thereafter, to issue order.


NOW THEREFORE, the Council hereby remands back the case of Global College of Higher Education, Mansa, Punjab to the NRC, NCTE, for necessary action as indicated above.
