O R D E R

WHEREAS the appeal of Dr. Rajendra Prasad Memorial Girls Degree College, Lucknow, Uttar Pradesh dated 16-08-2010 is against the decision taken in the 163rd meeting held on 29-07-10 to 31-07-10 of the Northern Regional Committee for withdrawing recognition for conducting B.Ed course on the grounds

1) The land is on private lease which is not permissible as per NCTE norms for B.Ed.

2) The deficiency related to number of computers still exist.

3) the proof in respect of qualification of appointment of Principal and faculty has not been submitted.

4) Still total number of titles of books, journals and encyclopedia are not as per NCTE norms for B.Ed”.

AND WHEREAS the Correspondent, Dr. Rajendra Prasad Memorial Girls Degree College (hereinafter referred to as the appellant), preferred an appeal dated 16-08-2010 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order.

AND WHEREAS Shri. Sharad Srivastava, Administrator, Dr. Rajendra Prasad Memorial Girls Degree College, Lucknow, Uttar Pradesh presented the case of the appellant institution on 15-09-2010. In the appeal and during personal presentation, it was submitted that the land on lease was registered under the orders of revenue Registrar. Such a lease registration was legally valid for all purposes. Special NCTE norms, if any, that made a legal registration unacceptable needed specification by the NRC so that college could fulfill the need urgently; The number of available 30 computers was earlier considered sufficient by the visiting team as well as Lucknow University panel members; The proof in respect of qualification of appointment of Principal and Faculty had been submitted and photocopy of the same was attached with appeal; total number of title of Books Journals and Encyclopedia were as per NCTE norms for B.Ed. In the panel report of Lucknow University, it was clearly mentioned that college was having 1000 Titles of Books and total of 3000 Books, 12 Journals and 4 Encyclopedia, which were sufficient for B.Ed Course.

AND WHEREAS the Council noted that the appellant in its application for recognition of B.Ed. course submitted to NRC on 20-12-06, the institution claimed that it was having 6000 Sq.mts. of land on long term lease for 90 years with a built-up area of 40,000 sq.ft. The Land Title Certificate submitted by the institution with the application also indicated availability of 6000 Sq.mts. of land. The institution was granted recognition for B.Ed. course from 2009-10 by NRC, vide its order dated 30-05-09. Thereafter, the NRC, in its 141st meeting held on 22nd to 24th May, 2009, decided to conduct an inspection of the institution under Section 17 of the NCTE Act, which empowers the Regional Committees of NCTE to take action in case of contraventions of provisions of Act-Rules-Regulations. Section 17 of the Act provides that where, the Regional Committee is, on its own motion or on any representation received from any person, satisfied that a recognized institution has contravened any of the provisions of the Act, or the Rules, Regulations orders made or issued thereunder or any condition subject to which recognition under Section 14 or permission under Section 15 was granted, it may withdraw recognition of such recognized institution, for reasons to be recorded in writing. Accordingly, the NRC got an inspection of the institution done by a Visiting Team. The VT Report dated 09-08-09 was negative and it, inter-alia, indicated that the building shown to the VT was in final stages of construction, the building shown to the team did not seem to be meant for education department as the structure was huge with two separate blocks, teachers were recruited but there were no teachers at the time of inspection and no students were allotted to the institution by university for 2009-10 being a zero session. The NRC issued a show-cause notice dated 22-06-10 and after considering the reply of the institution dated 03-07-10(received on 12-07-10) decided to withdraw recognition of the institution in the 163rd meeting of NRC held from 29th to 31st July, 2010, against which the present appeal was filed by the institution.

AND WHEREAS the Council also noted that alongwith application, the institution had submitted two private lease deeds dated 06-01-1998 for a period of 90 years in respect of a total land of 2 Bigha 10 Biswa or 6370 Sq.mts. in Khasra No. 1365 and 1366. The lease deeds were not registered and hence it was not valid as, as per Section 17 of the Registration Act, 1908, lease of immovable property for more than one year was required to be compulsorily registered, failing which it would not confer any right on the lessee, since transaction in violation of the said provision was null and void.

Further, alongwith the appeal, the institution produced another private lease deed dated 10-07-08 for a period of 30 years in respect of Building C-4-2, Rajajipuram with an area of 1875 Sq.mts. In the affidavit fated 24-03-07 submitted by the institution, it had claimed availability of 5000 Sq.mts. of land and a built-up area of 3000 Sq.mts. in Plot No.C-4-2, E Block, Rajajipuram, Lucknow. But, the registered lease deed dated 10-07-08 submitted with the appeal indicated that the built-up area of the building on Plot NO. C-4-2 was 1875 Sq.mts. as against 3000 Sq.mts. claimed in the affidavit. Further, the private lease deed is dated 10-07-08 and registered on 10-07-08, when private lease deed was not permissible as per NCTE Regulations, 2007, which came into force from 10-12-2007. Thus, the first ground of withdrawal of recognition that the land was on private lease, which was not permissible as per NCTE norms was valid. The VT Report dated 09-08-09 indicated that the number of computers available at the time of inspection was only five, which was inadequate and, thus, the second ground of refusal of recognition that deficiency related to number of computes still existed was also valid. the Council also found from the staff profile submitted that HOD now identified was not qualified. the Council was, therefore, of the view that recognition of the institution was withdrawn by the NRC for valid reasons and there was no ground for accepting the appeal.

AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, VT Report and after considering oral arguments advanced during hearing, the Council reached the conclusion that there was no ground to accept the appeal and hence it should be rejected. Accordingly, the appeal was rejected and NRC’s decision for withdrawal of recognition of the institution was confirmed.

NOW THEREFORE, the Council hereby confirms the Order appealed against.

WHEREAS the appeal of Dr. Rajendra Prasad Memorial Girl's Degree College, Lucknow, Uttar Pradesh dated 06-07-2010 is against the Order No. NRC-NCTE-F- 3-NRCAPP405-158 Meeting-2010-21747 dated 11-05-2010 of the Northern Regional Committee, refusing recognition for conducting D.E.C.Ed course on the grounds

1) CLU is not notarized.

2) Land is on private lease deed.

3) Khasra no. is not mentioned on the building plan and it is not approved by Competent Authority.”

AND WHEREAS the Correspondent, Dr. Rajendra Prasad Memorial Girl's Degree College (hereinafter referred to as the appellant), preferred an appeal dated 07-07-2010 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order.

AND WHEREAS Mr. Sharad, Administrative, Dr. Rajendra Prasad Memorial Girl's Degree College, Lucknow, Uttar Pradesh presented the case of the appellant institution on 17.09.10. In the appeal and during personal presentation it was submitted that the CLU is duly notarized; land is under registered lease deed for 90 years from the office of the Revenue Register, Lucknow; and Khasra number could not be inserted due to oversight and it is now included in the building plan duly signed by the competent authority.

AND WHEREAS the Council noted that the appellant has submitted with his appeal a No Objection Certificate issued by UP Housing and Development Board, Lucknow dated 15.3.2007 which bears a notarized signature of the same date; while the area in Khasra Nos 1365 and 1366 mentioned in this certificate is 625 sq. mtrs. in the application the appellant has claimed a land area of 6225 sq. mtrs which indicates that the NOC submitted does not cover the entire land; the documents produced in respect of land which are not clear and legible and do not contradict the observation of NRC that it is a private lease; and even though Khasra numbers have been incorporated in the building plan enclosed to the appeal, it does not indicate the total land area and built up area.

AND WHEREAS the Council considering all the above aspects of the matter has come to the conclusion that the NRC was justified in closing the file and therefore, the appeal deserved to be rejected and the order of NRC confirmed.

AND WHEREAS after perusal of documents, memorandum of appeal, affidavit and after considering oral arguments advanced during hearing, the Council reached the conclusion that there was no ground to accept the appeal and that it should be rejected. Accordingly, the appeal was rejected and NRC’s order dated 11-05-10 was confirmed.

NOW THEREFORE, the Council hereby confirms the Order appealed against.
