NCTE appeal order for SARASVATI VIDHYA NIKETANs SANSKAR COLLEGE OF EDUCATION Kudasan

O R D E R

WHEREAS the appeal of Saraswati Vidhya Niketan Seva Trust's Sanskar College of Education, Gandhinagar Dist., Gujarat dated 09-03-2009 is against the Order No. WRC-APWO4310-323426-109th-2008-50201 dated 23-01-2009 of the Western Regional Committee, withdrawing recognition for conducting B.Ed (Co-Ed) course on the grounds “Non compliance of S-c notice within stipulated time. (a) Society doesn't have its own land and building”.

AND WHEREAS the Correspondent, Saraswati Vidhya Niketan Seva Trust's Sanskar College of Education (hereinafter referred to as the appellant), preferred an appeal dated 19-03-2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order.

AND WHEREAS Shri Patel Dipak R., Managing Trustee and Shri Trivedi Dishang D., Representative, Saraswati Vidhya Niketan Seva Trust's Sanskar College of Education, Gandhinagar Dist., Gujarat presented the case of the appellant institution on 13-5-2009. In the appeal and during personal presentation it was submitted that while submitting the application by the institution in the year 2006 there was no provision for the land which could not be leased. It was also submitted that the delay in replying to the show cause
notice dated 3rd August, 2008 was on account of managing trustee being out of station for treatment of his son.

AND WHEREAS the Council noted that the application was submitted by the institution on 26th December, 2006 and as per the NCTE Regulation 8(5) of the NCTE (Recognition Norms and Procedure) Regulations, 2005 published on 13th Jan, 2006, an institution should have land free from all encumbrances either on ownership basis or on lease for a period not less than 30 years in order to be eligible for grant of recognition. The land and built up area for B.Ed. course as per NCTE Norms were 2500 sq.mt. and 1500 sq.mt. respectively. The Council also noted that the institution had submitted two rent agreement dated 30th November, 2006 and 16th April, 2007. As per the rent agreement dated 30th
November, 2006, a built up area of 772 sq. mt. on 3rd and 4th floor of a building was hired and as per next agreement dated 16th April, 2007 additional 2nd floor in the same building was hired and the institution hired a total built up area of 1444 sq.mt. as against the requirement of minimum of 1500 sq.mt. as per NCTE norms. The said two agreements were not registered. Further the Council also noted that the institution was not in possession of any land as rent agreement covered only built up area of 2nd, 3rd and 4th floor. The Council also noted that this was one of the institutions which were inspected and not found to be in order by the A.U. Patel Committee appointed by the Govt. of Gujarat and the recognition of the institution was withdrawn by WRC after getting inspection of the institution conducted u-s 17 of NCTE Act. Therefore, the Council was of the view that the recognition of the institution was withdrawn by WRC on valid ground and that there was no justification for accepting the appeal.

AND WHEREAS after perusal of documents, memorandum of appeal, affidavit and after hearing oral arguments advanced during the hearing, the Council reached the conclusion that there was no justification for accepting the appeal and that it should be rejected. Accordingly the appeal was rejected and order of WRC dated 23-01-2009 was confirmed.

NOW THEREFORE, the Council hereby confirms the Order appealed against.
