NCTE appeal order for MILLAT TEACHERS TRAINING COLLEGE Madhubani

O R D E R

WHEREAS the appeal of Millat Teachers Training College, Madhubani, Bihar dated 12-11-2009 is against the Order No. F.No. BR-S-N-40-08-14520 dated 26-10-2009 of the Eastern Regional Committee, against recognition for conducting B.P.Ed course on the grounds “The appellant institution has been granted recognition for B.P.Ed course of one year duration with an intake of 50 for the academic session 2009-2010.”

AND WHEREAS the Correspondent, Millat Teachers Training College (hereinafter referred to as the appellant), preferred an appeal dated 13-11-2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order.

AND WHEREAS Dr. Faiyaz Ahmad, Secretary and Dr. S.K. Mishra, Millat Teachers Training College, Madhubani, Bihar presented the case of the appellant institution on 13.01.2010. In the appeal and during personal presentation it was submitted that the appellant applied to the ERC for an intake of 100 in the B.P.Ed. programme. It provided the facilities and requirements for an intake of 100 and the same was brought to the notice of ERC through its reminder letter, but the ERC granted recognition for B.P.Ed. programme for an intake of 50, instead of 100 intake.

AND WHEREAS the Council noted that as per Regulations, an institution shall be considered for grant of recognition for only one course for the basic unit as prescribed in the norms and standards for the particular teacher education programme and under the norms and standards of B.P.Ed. degree, it has been stated the intake shall be a basic unit of 50 students. In view of the above the Council came to the conclusion that there was no justification in accepting the appeal and that should be rejected as the ERC was right in granting recognition for a basic unit of 50 in B.P.Ed. programme.

AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, VT Report and after considering oral arguments advanced during hearing, the Council reached the conclusion that there was no ground to accept the appeal and that it should be rejected.

Accordingly, the appeal was rejected and ERC‟s order dated 26-10-09 was confirmed

NOW THEREFORE, the Council hereby confirms the Order appealed against.

WHEREAS the appeal of Millat Teachers' Training , Bhowara, Bihar dated 18-08-2009 is against the Order No. ERC-7-99.6(I)(1S)17-2009-1113 dated 05-08-2009 of the Eastern Regional Committee, refusing recognition for conducting B.P.Ed. course on the grounds

1) On the basis of the testimonials submitted in respect of the HOD appointed, the person does not posses experience as per NCTE norms.

2) The institution not submitted downloaded copies of the website showing that all the documents has been uploaded in the website of the institution as per NCTE Rulees and Regulation.

3) As per details submitted by the institution, the built up area of the institution is 26897 sq.ft. The institution has submitted affidavit exclusively for B.P.Ed course the built up area is 10100 sq.ft. The institution not submitted the land and Building area as per the NCTE norms”.

AND WHEREAS the Correspondent, Millat Teachers' Training (hereinafter referred to as the appellant), preferred an appeal dated 18-08-2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order.

AND WHEREAS Dr. F. Ahmad, Representative and Dr. S.K. Mishra, Authorised Signatory, Millat Teachers' Training , Bhowara, Bihar presented the case of the appellant institution on 17-09-09.

In the appeal and during personal presentation it was submitted that all the requisite documents in regard to the selection committee were forwarded to the ERC and all the faculty including HOD were qualified as per the NCTE Norms. It was also submitted that the institution was having the requisite land and built up area on ownership basis as per the NCTE norms.

AND WHEREAS the Council noted that the deficiencies pointed out were removed by the institution vide its letter dated 27-9-09 and as per the papers available on the file the new HOD appointed was qualified. It was also noted that since Letter of Intent prior to recognition (conditional recognition) was supposed to be granted by the Regional committee only after satisfying that the institution concerned fulfilled the prescribed norms regarding availability of adequate infrastructure facility and therefore once the letter of intend prior to recognition was issued, it was not open to the regional committee to raise the issue of inadequacy in infrastructure facility as a ground for rejection of recognition. It was further noted from the minutes from 98th meeting of the ERC held on 15th to 16th July, 2009, decision to accord formal recognition to the institution was taken. Since, the institution removed the deficiency regarding the HOD on 27-07-2009, the new HOD was qualified as per NCTE norms and the institution fulfilled other requirements, the Council was of the view that there was adequate justification to accept the appeal.

AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, VT Report and after hearing oral arguments advanced during the hearing, the Council reached the conclusion that there was enough ground to accept the appeal and reverse ERC’s order dated 05-08-09 Accordingly, the appeal was accepted and ERC’s order dated 05-08-09 was reversed, with direction to the ERC to grant recognition to the institution immediately, within 15 days of issue of this order.

NOW THEREFORE, the Council hereby reverses the Order appealed against.
