O R D E R

WHEREAS the appeal of Shimla College of Education, Shimla, Himachal Pradesh dated 04-05-2010 is against the Order No. F.No-NRC-Acad.-Misc-2010-20648 dated 22-04-2010 of the Northern Regional Committee, rejecting the application for recognition for conducting D.El.Ed course on the grounds that as per Clause 8(7) (i) of NCTE Regulations, 2009, “ no institution shall be granted recognition under these regulations unless the institution or society sponsoring the institution is in possession of required land on the date of application. Land free from encumbrances could be either on ownership basis or on lease from Government- Government institutions for a period of not less than 30 years. Your application for D.El.Ed. course is supported with land documents of private lease (notarized) which is not as per requirement of clause 8(7) (i) of NCTE Regulations 2009”.

AND WHEREAS the Correspondent, Shimla College of Education (hereinafter referred to as the appellant), preferred an appeal dated 04-05-2010 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order.

AND WHEREAS Dr. R.K. Shandil, Chairman, Shimla College of Education, Shimla, Himachal Pradesh presented the case of the appellant institution on 19-06-2010. In the appeal and during personal presentation, it was submitted that the jannabandi and Trust Deed had not been scrutinized which showed that the Society Trust sponsoring the institution was owner in possession of 8032 sq.mts. of Land on the date of application. The lease deed in question was executed from this Land on 28-09-2006 incompliance to NCTE requirements contained in letter dated 18-09-2006.

AND WHEREAS the Council noted that Clause 8(7) (i) of NCTE Regulations, 2009, stipulated that no institution shall be granted recognition under the Regulations unless the institution or society sponsoring the institution was in possession of required land on the date of application free from all encumbrances either on ownership basis or on lease from Govt.-Govt. institutions. The applicant institution submitted a lease deed dated 28-09-06 between Dr. R.K. Shandil, Chairman, Shimla Education Society and Trust and Shimla College of Education for a period of 30 years from 27- 09-06. Thus, the requirement of Clause 8(7) (i) of NCTE Regulations, 2009 was not satisfied in this case. Therefore, the Council was of the view that the application of the institution was rejected by NRC for valid reasons and, thus, there was no ground to accept the appeal.

AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, VT Report and after considering oral arguments advanced during hearing, the Council reached the conclusion that there was no ground to accept the appeal and hence it should be rejected. Accordingly, the appeal was rejected and NRC’s order dated 22-4-10 was confirmed.

NOW THEREFORE, the Council hereby confirms the Order appealed against.
