NCTE appeal order for Namdhari Education Society Sundernagar

O R D E R

WHEREAS the appeal of Namdhari College of Education, Mandi, Himachal Pradesh dated 10-06-2010 is against the Order No. NRC-NCTE-F-3-HP-275-157 Meeting-2010-20486 dated 16-04-2010 of the Northern Regional Committee, refusing recognition for conducting M.Ed course on the grounds “In respect of HP-275, the file is closed as the basic unit of B.Ed, has been withdrawn.”

AND WHEREAS the Correspondent, Namdhari College of Education (hereinafter referred to as the appellant), preferred an appeal dated 10-06-2010 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order.

AND WHEREAS Sh. Rishi Singh, Chairman, Namdhari College of Education,
Mandi, Himachal Pradesh presented the case of the appellant institution on 18-08-2010. In the appeal and during personal presentation, it was submitted that the decision of the NRC taken in its 153rd meeting held on 11-12th December, 2007 to withdraw recognition for B.Ed. course being conducted by the appellant institution from the academic session 2010-11 (which was followed by NRC’s Order No. NRC-NCTE-F-7-HP-201-153rd Meeting - 2009-20284 dated 13.4.2010) had been reversed in appeal and directed the NRC to restore recognition. In the circumstances he appealed that the file relating to grant of recognition for M.Ed. cannot be closed on the ground that recognition for B.Ed. was withdrawn.

AND WHEREAS the Council noted that the Appellate Authority vide their
appellate order dated 7.6.2010 set aside the NRC’s decision, with the direction to the NRC for restoration of recognition. The Council also noted that the NRC in their letter F.No. NRC-NCTE-HP-275-154th Meting-2009-15343 dated 20.12.2010 issued orders under the provisions of clause 7(9) of the NCTE Regulations, 2007 to the appellant institution for conducting M.Ed. Course and the institution has also submitted their reply. The Council taking all aspects of the matter into consideration came to the conclusion that the appeal deserved to be accepted, the order of the NRC dated 13.4.2010 reversed with the direction to the NRC to examine the documents relating to faculty profile after obtaining the same from the appellant institution and for further action thereafter as per regulations.

AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, VT Report and after considering oral arguments advanced during hearing, the Council reached the conclusion that there was enough ground to accept the appeal and reverse the order of the NRC dt. 16-04-10 with the direction to NRC to examine the documents relating to faculty profile after obtaining the same from the appellant institution and for further action thereafter.

NOW THEREFORE, the Council hereby reverses the Order appealed against.

WHEREAS the appeal of Namdhari College of Education (Namdhari Education Society), Mandi, Himachal Pradesh dated is against the decision of the NRC in its 153rd meeting held on 11th-12th Dec’09 withdrawing recognition for conducting B.Ed course on the grounds “1. The land is not in the name of the institution. 2) The experience certificate and mark sheets of the appointed principal are not submitted. 3) Affidavit on Rs. 10-- stamp paper is not submitted in respect of appointed faculty and principal. 4) The labs are smaller in size. 5) The number of titles is not as per NCTE norms for B. Ed. 6) Language learning facility still does not exist.”

AND WHEREAS the Correspondent, Namdhari College of Education (Namdhari Education Society) (hereinafter referred to as the appellant), preferred an appeal dated 05-02-2010 to the National Council for Teacher Education, New Delhi
(hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order.

AND WHEREAS Shri Rishi Singh, President, Namdhari College of Education (Namdhari Education Society), Mandi, Himachal Pradesh presented the case of the appellant institution on 15.03.10. In the appeal and during personal presentation it
was submitted that the appellant’s society “Namdhari Education Society” was in possession of 06.12.08 bighas of land as per sale deed dt. 21.06.08; it submitted experience certificate and marks sheet of the appointed principal. Dr. Aman; Italso also submitted the affidavits of individual faculty members on Rs. 10-- stamp paper, size of lab was as per norms and this had been observed by the visiting teams that inspected the institution under section 17, on 03.07.09 and also by the team that visited the institution on 21.08.09, for assessing the facilities available with the institution. Library was having adequate No. of books as per norms and it was also having language learning facilities.

AND WHEREAS the Council deferred decision on the appeal for want of certain information-documents from the NRC, Jaipur on that day. After receipt of requisite information-documents from the NRC, the appeal was again considered by the Council on 01-05-10. the Council noted that application of the institution for recognition of B.Ed. course was submitted to the NRC on 28-12-06. In the application, the institution had indicated that it was in possession of 5358 Sq.mts. of land and building thereon with 1355 Sq.mts., on lease for 30 years. The NRC issued a deficiency letter dated 23-01-07, inter-alia, pointing out that affidavit on Rs.100 stamp paper and details website of the institution were not submitted and allowing the institution ninety days to remove the deficiencies. The institution furnished its reply vide its letter dated 18-04-07 furnishing details of the of website alongwith an affidavit in original dated 16-04-07 in which it claimed that it was having 8213 Sq.mts. of land and builtup area of 1355 Sq.mts. In response to that the NRC vide its letter dated 23-06-07
pointed out that as per norms the minimum built-up area required for B.Ed. course was 1500 Sq.mts. and aksed the institution to clarify the position and submit proper documents within 21 days. The institution, vide its letter dated 03-07-07, furnished revised building plan, affidavit dated 02-07-07 claiming availability of 7220 Sq.mt. of land and built-up area of 2269 Sq.mts. A building completion certificate dated 03-07- 07 showing a built-up area of 2268 Sq.mts. was also submitted.

The NRC got an inspection of the institution conducted by a visiting team of experts on 02-09-07. The VT report dated 02-04-07 was positive and the NRC granted recognition to the institution for B.Ed. course vide order dated 13-09-07. Subsequently, a complaint against some recognized colleges in Himachal Pradesh including the Namdhari College of Education, was received in NCTE Hqrs. and the same was forward to the NRC, vide NCTE (HQ) letter No.F.38-5(64)-2008-NCTE-CDN dated 22-12-08 for appropriate action as per the provisions of the NCTE Act.. The NRC got an inspection of the institution conducted on 03-07-09 under Section 17 of the NCTE Act, 1993. The VT report dated 03-07-09 inter-alia, indicated that (i) college building was situated in the market where there was lot of noise pollution; (ii) earlier the land was on lease and now the society purchased it on its name; (iii) the building was not suitable for running educational institution; (iv) three faculty members were approved by the affiliating university and the other three were working on ad-hoc basis; (vi) the area of lab was not according to NCTE norms. The NRC issued a show cause notice dated 22-07-09 pointing out the various deficiencies and asking the institution to show cause why its recognition should not be withdrawn under Section 17 of the NCTE Act.

After consideration of the reply dated 10-08-09 to the show cause notice and other facts, the NRC, vide its order dated 13-04-10 withdrew the recognition of the institution from the academic session 2010-11. The appeal dated 05.02.10 under
consideration is against the said order of NRC dated 13-04-10. The Council noted that NRC caused inspection of the institution on 03.07.09 under section 17 of the NCTE Act and on the basis of this report NRC issued a show cause notice on 27.07.09 inter-alia mentioning that the land documents were not shown to the VT members; the principal is not in position; only 3 faculty members in position are approved by the affiliating university; laboratories are small; the number of titles in the library are not as per NCTE norms; language learning facilities are not available. The appellant made a representation on 10.08.09 to the NRC stating that land was on ownership basis in the name of the society and these documents were shown to the visiting team; the institute was having four lecturers previously approved by H.P. University, Shimla and further selected 3 more lecturers and a principal following the laid down procedure and involving the university nominee in the selection committee; library was having 1016 titles and in proof this it submitted the bills; the institution had provision for 10 cabins for language lab with proper equipments. The Council also noted that the institution was granted recognition on leased premises on 13.09.07as per the prevailing regulations. The appellant purchased the leased premises an ownership basis in the name of the society on 21.06.08; the institution was not given an opportunity by the NRC for submitting experience certificate and mark sheets of the appointed principal and affidavits on Rs. 10--stamp paper for the appointed faculty. The appellant however presented before the appeal committee the experience certificate and mark sheets of the appointed principal Dr. Aman who is qualified as per norms and also the affidavits of the appointed faculty on Rs. 10-- stamp paper; further the appellant was having adequate facilities in the language learning lab and requisite no. of books and titles in the library. In view of the above the Council came to the conclusion that there was adequate ground to accept the appeal and remand the case to the NRCfor restoration of recognition given to it for conducting B. Ed programme and further NRC may give more three months time for transfer of the land in the name of the institution.

AND WHEREAS after perusal of documents, memorandum of appeal, VT Report, affidavit and after considering oral arguments advanced during hearing, the Council reached the conclusion that there was enough ground to accept the
appeal and that it should be accepted. Accordingly, the appeal was accepted and NRC’s decision dated 11th-12th Dec’09 was set aside with a direction to the NRC for restoration of recognition given it for conducting B.Ed Programme and further to give more three months time for transfer of the land in the name of the institution.

NOW THEREFORE, the Council hereby reverses the Order appealed against.
