O R D E R
WHEREAS the appeal of Janak Raj Mahajan B.Ed. College, Kangra, Himachal Pradesh dated 30-04-2009 is against the Order F.No.NRC-NCTE-HP294-2008 dated 24-4-09 of the Northern Regional Committee, rejecting the application for
recognition for conducting B.Ed course (additional intake) on the grounds
1) CLU is not submitted
2) NAAC certificate is not submitted.
3) Land is in the name of society but not Institution.
4) No Resolution of Gram Panchayat in respect of approval of Building Plan.
5) Building Plan does not indicating khasra-plot number, total area and built up area.
AND WHEREAS the Correspondent, Janak Raj Mahajan B.Ed. College (hereinafter referred to as the appellant), preferred an appeal dated 30-04-2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order.
AND WHEREAS Shri Ravti Raman, Chairman, Janak Raj Mahajan B.Ed. College, Kangra, Himachal Pradesh presented the case of the appellant institution on 22-07- 09. In the appeal and during personal presentation, it was submitted that CLU was furnished to the NRC alongwith insitutions letter dated 01-09-08, the application of the institution was submitted on 10-12-07 and as per para No.8(6) of the NCTE Regulations, 2007, all the applications for additional intake in B.Ed. and B.P.Ed. on or before the date of notification of the Regulations, 2007 i.e. 10-12-07 were to be considered as per the provisions in the NCTE Regulation, 2005 according to which NAAC certificate was not compulsory, the land belonged to the Janak Raj Mahajan Educational and Welfare Society, which runs the Janak Raj Mahajan B.Ed. College, the Resolution regarding the approval of building plan was obtained by the institution from the Gram Panchayat Gangath vide letter dated 6-01-07 but it was never demanded by the NRC and the building plan submitted indicated the details of the built up area but admitted that the building plan as also CLU and the resolution of the Panchayat did not indicate khasra number.
AND WHEREAS the Council noted that as per Regulation 8(6) of the NCTE Regulations, 2007, applications received on or before 10-12-07 for additional intake in B.Ed. were to be processed without insisting on NAAC certification and, therefore, non-possession of NAAC certificate alone cannot be a valid reason for rejection of the application. Further, as per Regulation 8(5) an institution that has been granted
additional intake in B.Ed. course after promulgation of the Regulations 2005 shall have to be accredited itself with the NAAC with a Letter Grade B under the new grading system developed by NAAC before 1st April, 2010 failing which the additional intake granted shall stand withdrawn w.e.f. the academic session 2010- 2011. Therefore, the Council was of the view that there was enough justification for accepting the appeal.
AND WHEREAS after perusal of documents, memorandum of appeal, affidavit and after hearing oral arguments advanced during hearing, the Council reached the conclusion that there was enough ground to accept the appeal and that it should be accepted. Accordingly, the appeal was accepted and NRCs order dated 24.04.2009 was reversed.
NOW THEREFORE, the Council hereby reverses the Order appealed against.
