O R D E R

WHEREAS the appeal of Shree Saraswati Gyanpeeth Shiksha Mahavidyalaya (Shree Vidyadayani Maa Saraswati Shikshan Sanstha Samiti), Devas, Madhya Pradesh dated 21-07-2009 is against the decision of Western Regional Committee in its 121st meeting held on 8-9th July, 2009, refusing recognition for conducting B.Ed course on the grounds “ Reply not received within stipulated time period. Hence application rejected file closed.

AND WHEREAS the Correspondent, Shree Saraswati Gyanpeeth Shiksha Mahavidyalaya (Shree Vidyadayani Maa Saraswati Shikshan Sanstha Samiti) (hereinafter referred to as the appellant), preferred an appeal dated 21-07-2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order.

AND WHEREAS Shri Abhay Jain Coordinator, Shree Saraswati Gyanpeeth Shiksha Mahavidyalaya (Shree Vidyadayani Maa Saraswati Shikshan Sanstha Samiti), Devas, Madhya Pradesh presented the case of the appellant institution on 14.09.09.

In the appeal and during personal presentation it was submitted that the appeal had been preferred on the basis of the information perused from the website and no notice was received from the NRC for which a reply could be sent. Appellant stating further that they have not admitted any student for the session 2007-08 the recognition for the institution may be restored from 2008-09.

AND WHEREAS since this institution’s case is connected to Amrit Vidyapeeth Case which was considered by the Hon’ble High Court of Madhya Pradesh, the Council was of the opinion that the institution cannot be treated as a recognised institution during the academic session 2007-08. However, it would continue as a recognised institution from the session 2008-09 onward, as the inspection conducted by NCTE Hqrs, on the direction of Hon’ble Court on 10th jan’2009 indicated that the institution possess the required infrastructure i.e. 2582 sq. mts of land and 16,856 sq. ft. of builtup area. The staff in the institution has been appointed with the approval of the University.

AND WHEREAS after perusal of the documents, memorandum of appeal, report of the inspection conducted by NCTE Hqrs in 2009 the Council came to the conclusion that the institution would remain in the category of Amrit Vidyapeeth and would not be recognised institute during the session 2007-08 but would be a recognised institute from 2008-09 onward.
