O R D E R

WHEREAS the appeal of Dr. Shankar Dayal Sharma Smriti Mahavidyalaya, Bhopal , Madhya Pradesh dated 16-03-2009 is against the Order No. WRC-APWO3789-222194-114th-2008-51852 dated 28-02-2009 of the Western Regional Committee, Refusing recognition for conducting D.Ed course on the grounds that The inspection was carried out at Ramnagar and built up area is not sufficient as per the NCTE norms.

AND WHEREAS the Correspondent, Dr. Shankar Dayal Sharma Smriti Mahavidyalaya (hereinafter referred to as the appellant), preferred an appeal dated 16-03-2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order.

AND WHEREAS Shri Kanhaya Lal Amarnani Chairman, Dr. Shankar Dayal Sharma Smriti Mahavidyalaya, Bhopal , Madhya Pradesh presented the case of the appellant institution on 28-05-2009. In the appeal and during personal presentation it was submitted that the appellant applied against the Refusal Order of WRC and the Appellate Authority remanded back the case to WRC for causing the inspection of the institution and thereafter pass appropriate orders. Accordingly, WRC caused re-inspection of the institution on 31-07-08 and after considering this report, again issued order of refusal of recognition. During the presentation, it was submitted that re-inspection of the institution was conducted at Bhauri Village where they were already running B.Ed. course. It was also submitted that the application was submitted for conducting D.Ed course at the address in Ram Nagar and thus the first inspection was conducted on 16-2-07 at Ram Nagar address; Later it shifted to own premises having adequate land and built up area for conducting both B.Ed. and D.Ed. at Bhauri Village and Ram Nagar building was meant for postal and administrative purpose.

AND WHEREAS the Council noted that the appellant was already conducting B.Ed. and applied for D.Ed., in a rental premises at Ram Nagar. At the time of application it was in possession of land at Bhauri village where it constructed a new building and shifted the B.Ed. course to Bhauri village from Ram Nagar, without prior approval of WRC. Now it intended to run D.Ed. alongwith B.Ed. at Bhauri Village, hence the inspection team was ferried from Ram Nagar to Bhauri Village by the college authorities and this new building was inspected on 31-07-08 by the team. The Council noted that WRC refused recognition for conducting D.Ed. course on the grounds that the building was incomplete as per affidavit, and the appellate authority upon consideration of the appeal, remanded back the case for re-inspection of the institution, to ascertain its readiness to conduct the course. In compliance to this order WRC caused re-inspection of the building at Ram Nagar as per the application submitted by the institution, but the school authority made the team to inspect the building at Bhauri Village, which was not the location of the building as shown in the application. It further noted from the inspection report that inspection was carried out at plot No.8-9, Ram Nagar colony where as it enclosed the map of plot No.348-211 of village Bhauri also alongwith its report. The Council, therefore, came to a conclusion that there was no justification in accepting
the appeal and that it should be rejected.

AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, VT Report, written submission given and after hearing oral arguments advanced during hearing, the Council reached the conclusion that there was no ground to accept the appeal and that it should be rejected. Accordingly, the appeal was rejected and WRCs order dated 28- 2-09 was confirmed

AND WHEREAS

NOW THEREFORE, the Council hereby confirms the Order appealed against.
