O R D E R

WHEREAS the appeal of Indira Gandhi Girls Degree College, Gorakhpur, Uttar Pradesh dated 05-02-2010 is against the Order No. F.NRC-NCTE-F-7-UP-2502-141st Meeting-2009-10198 dated 09-09-2009 of the Northern Regional Committee, refusing recognition for conducting BTC course on the ground “Deficiencies communicated in the deficiency letter issued by the office are not removed within stipulated period.”

AND WHEREAS the Correspondent, Indira Gandhi Girls Degree College (hereinafter referred to as the appellant), preferred an appeal dated 05-02-2010 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order.

AND WHEREAS Shri Ramesh Singh, Principal, Indira Gandhi Girls Degree College, Gorakhpur, Uttar Pradesh presented the case of the appellant institution on 16-09-2010. In the appeal and during personal presentation it was submitted that the appellant did not receive the deficiency letter and further NRC, without giving show cause notice closed the file of the appellant institution; it invested huge amount in equipping the institution’s infrastructure and instructional facilities as per NCTE norms. The appellant further submitted that the institution was granted recognition for B.Ed. programme w.e.f. 2008-09 and B.P.Ed. course matter was in the appeal at present.

AND WHEREAS the Council noted that the NRC vide letter dt. 23.06.07 conveyed certain deficiencies to the institution, which was purportedly not received by the institution and the appellant also contested that as per the provisions of the closing the file of the institution without issuing any show cause notice, was contrary to the provisions contained under section 14 of the NCTE Act. However, the Council noted that the institution had been conducting B.Ed. programme since 2008-09 and it had not completed three academic sessions. The Council was therefore of the view that there was adequate justification in accepting the appeal, with the direction to the NRC to issue a show cause notice in reference to the deficiencies pointed by it in the letter dt. 23.06.07 and also recognition granted to it for B.Ed. programme.

AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, and after considering oral arguments advanced during the hearing, the Council reached the conclusion that there was adequate ground to accept the appeal and reverse NRC’s order dated 09-09-09 with direction to the NRC to issue a show cause notice in reference to the deficiencies pointed by it in the letter dt. 23.06.07 and also recognition granted to it for B.Ed. programme.

NOW THEREFORE, the Council hereby reverses the Order appealed against.

WHEREAS the appeal of Indira Gandhi Girls Degree College, Gorakhpur, Uttar Pradesh dated 31-08-2009 is against the Order No. F. NRC-NCTE-F73-UP-2458-141st Meeting-2009-9077 dated 28-08-2009 of the Northern Regional Committee, refusing recognition for conducting B.Ed course on the grounds “The list of appointed faculty as per NCTE norms has not been submitted till date”.

AND WHEREAS the Correspondent, Indira Gandhi Girls Degree College (hereinafter referred to as the appellant), preferred an appeal dated 31-08-2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order.

AND WHEREAS Shri Ramesh Singh, Teacher, Indira Gandhi Girls Degree College, Gorakhpur, Uttar Pradesh presented the case of the appellant institution on 30-11-09.

In the appeal and during personal presentation it was submitted that the institution was issued letter of intent prior to recognition 20-02-2008 and in compliance to this the institution selected the faculty following the procedure laid down in the NCTE norms; institution wrote a letter to the Gorakhpur University on 5-5-08, asking for nomination of University experts for the Selection Committee; Selection Committee on 13-06-2008 selected the faculty and the list of teaching staff was duly approved by D.D. University, Gorakhpur on 09-08-2008; The faculty details alongwith the requisite affidavits were furnished to NRC on 15.08.08 through “FLYKING” courier which were received by NRC on 19.08.08.

AND WHEREAS the Council noted that the institution selected the faculty by a duly constituted selection committee and the list was approved by the affiliating body; It further examined faculty profile and found that the staff was qualified as per NCTE norms. In view of the above, the Council came to the conclusion that there was adequate justification in accepting the appeal.

AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, VT report and after considering oral arguments advanced during the hearing, the Council reached the conclusion that there was adequate ground to accept the appeal and reverse NRC’s order dated 28-08-09 with direction to the NRC to grant recognition to the institution within 15 days of issue of this order.

NOW THEREFORE, the Council hereby reverses the Order appealed against.

WHEREAS the appeal of Indira Gandhi Girls Degree College, Gorakhpur, Uttar Pradesh dated 20-10-2009 is against the Order No. F.NRC-NCTE-F-7-UP-2470-145th Meeting-2009-10769 dated 26-09-2009 of the Northern Regional Committee, refusing recognition for conducting B.P.Ed course on the grounds “The reply to the institution has not been received in the stipulated time”.

AND WHEREAS the Correspondent, Indira Gandhi Girls Degree College (hereinafter referred to as the appellant), preferred an appeal dated 20-10-2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order.

AND WHEREAS Shri Ramesh, Teacher, Indira Gandhi Girls Degree College, Gorakhpur, Uttar Pradesh presented the case of the appellant institution on 02-12-09.

In the appeal and during personal presentation it was submitted that the appellant in response to NRC’s letter dt. 19.05.09 submitted requisite documents on 05.06.09 through a courier service and also on 09.06.09 at the NRC office, Jaipur by a special messenger and in proof of its submission the appellant showed a document with receiving stamp of NRC office.

AND WHEREAS the Council noted that NRC vide its letter dt. 19.05.09 informed the institution to submit photocopy of accession register and original bills of additional books purchased, within 21 days. However, the Council observed that since the institutions’ letter dated 5-6-09 has been received and was duly signed as a token of its receipt, the NRC was not justified in refusing the recognition and not processing the application further. It further examined photocopies of the purchase bills of the books and also accession register. In view of the above the Council came to the conclusion that there was adequate justification in accepting the appeal to be remanded to NRC for issuance of letter of intent prior to grant of recognition under Clause 7(9) of the NCTE Regulations.

AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, VT report and after hearing oral arguments advanced during the hearing, the Council reached the conclusion that there was adequate ground to accept the appeal, set aside NRC’s order dated 26-09-09 and remand the case to NRC for issuance of letter of intent prior to grant of recognition under Clause 7(9) of the NCTE Regulations, within 15 days of issue of this order.

NOW THEREFORE, the Council hereby remands back the case of Indira Gandhi Girls Degree College, Gorakhpur, Uttar Pradesh to the NRC, NCTE, for necessary action as indicated above.

WHEREAS the appeal of Indira Gandhi Girls Degree College, Gorakhpur, Uttar Pradesh dated 02-07-2010 is against the Order No. NRC-NCTE-F-3-UP-2470-158 Meeting-2010-21730 dated 11-05-2010 of the Northern Regional Committee, refusing recognition for conducting B.P.Ed course on the ground “The institution was issued 7(9) which has not been replied till date.”

AND WHEREAS the Correspondent, Indira Gandhi Girls Degree College (hereinafter referred to as the appellant), preferred an appeal dated 06-07-2010 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order.

AND WHEREAS Dr. Ramesh Singh, Principal, Indira Gandhi Girls Degree College, Gorakhpur, Uttar Pradesh presented the case of the appellant institution on 20.08.10. In the appeal and during personal presentation it was submitted that the letter of intent prior to grant of recognition was issued on 18.02.10 directing the institution to comply with faculty appointment following the laid down procedure within 21 days. The appellant immediately advertised for the posts on 25.02.10 and also sent a request letter dt. 25.12.10 to the university for nominating subject expert; and this was brought to the notice of NRC vide their registered letter dt. 12.03.10. The university vide their letter dt. 03.05.10 constituted the selection committee, interviews were held on 23.05.10 and selected a principal and five lecturers, the selected faculty list was approved by the university on 16.07.10. The delay caused in appointing the faculty was owing to the procedure involving the affiliating university.

AND WHEREAS the Council noted that it was not possible for the institution to complete the process of selection and appointment of qualified faculty as per norms within the 21 days allowed by NRC. Further, the appellant also kept informed NRC about the on going process of selection procedure. And also the staff was selected following the laid down procedure and it had been approved by the university. The Council therefore came to the conclusion that there was adequate justification in accepting the appeal with the direction to the institution to submit all the documents related to faculty selection and appointment as per norms and the NRC shall examine the faculty profile and pass appropriate orders thereafter.

AND WHEREAS after perusal of documents, memorandum of appeal, affidavit and after considering oral arguments advanced during the hearing, the Council reached the conclusion that there was adequate ground to accept the appeal and reverse the NRC’s order dated 11-05-10 with the direction to NRC for examining the faculty profile and pass appropriate orders thereafter.

NOW THEREFORE, the Council hereby reverses the Order appealed against.
