O R D E R

WHEREAS the appeal of Mata Surajmukhi Girls Degree College of Commerce and Economics, Agra Dist., Uttar Pradesh dated 20-02-2009 is against the Order No. F.NRC-NCTE-F-7)UP dated 06-01-2009 of the Northern Regional Committee, Refusing recognition for conducting B.Ed course on the grounds “As per NCTE Regulation dated 10.12.2007 private lease documents not acceptable. Hence the Council decided to reject the application or B.Ed. course”.

AND WHEREAS the Correspondent, Mata Surajmukhi Girls Degree College of Commerce and Economics (hereinafter referred to as the appellant), preferred an appeal dated 20-02-2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order.

AND WHEREAS Shri Nahar Singh, Manager-Secretary and Shri Shiv Kumar Office Assistant, Mata Surajmukhi Girls Degree College of Commerce and Economics, Agra Dist., Uttar Pradesh presented the case of the appellant institution on 12.05.2009. In the appeal and during personal presentation it was submitted that the appellant institution had submitted its application for the grant of recognition to run the B.Ed Course on 28-1-2008, but much before the date the institution was validly in physical possession of the required land and that there was no such type of requirement that the land must be own or leased
from the Government agencies.

AND WHEREAS the Council noted that the application of the institution was received by NRC on 28-1-2008 and that as per NCTE Regulation 8(7) of the NCTE (Recognition Norms and Procedure) Regulations 2007 which came in to force from 10-12-2007, no institution shall be granted recognitions under the regulation unless it was in possession of required land on the date of application and that the land free from all encumbrances should be either on ownership basis or on lease from Government-Government institution for the period not less than 30 years and therefore the institution was not eligible for grant of recognition as it was not having the required land on ownership basis or on lease from Government-Government institution. The Council was therefore of the view that there was no justification to accept the appeal.

AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, written submission made and after hearing oral arguments advanced during the hearing, the Council reached the conclusion that there was no justification for accepting the appeal and that it should be rejected.

Accordingly the appeal was rejected and order of NRC dated 06-01-2009 was confirmed.

NOW THEREFORE, the Council hereby confirms the Order appealed against.
