O R D E R

WHEREAS the appeal of Shri Ram College, Muzaffar nagar, Uttar Pradesh dated 02-07-2010 is against the Order No. NRC-NCTE-F-3-NRCAPP230-158 Meeting-2010-21597 dated 07-05-2010 of the Northern Regional Committee, refusing recognition for conducting D.El.Ed course on the grounds

1) The institution has not completed three academic sessions of running M.Ed and M.P.Ed courses.

2) Land documents are not certified.

3) CLU is not submitted.

4) The submitted building plan is the photocopy and not readable.

5) Coursewise demarcated area is not indicated in the plan.”

AND WHEREAS the Correspondent, Shri Ram College (hereinafter referred to as the appellant), preferred an appeal dated 05-07-2010 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order.

AND WHEREAS Dr. S.C. Kulshreshtha, Chairman, Shri Ram College, Muzaffar nagar, Uttar Pradesh presented the case of the appellant institution on 16-09-2010. In the appeal and during personal presentation it was submitted that

(1) the NRC granted recognition for M.Ed. course vide order dt. 12.08.08 and for M.P.Ed. course vide order dt. 12.08.08 and the institution had been conducting these two courses w.e.f. 2008-09 academic session. As such the affiliation by the State Govt. takes almost 5-6 years.

(2) The land documents submitted by the appellant were totally certified.

(3) CLU submitted was issued by the competent authority viz Muzafarnagar Development Authority.

(4) The building plan submitted by the appellant was approved by Muzzafarnagar Development Authority and the original map being a single copy was not submitted to the NRC, as it was required by the appellant, if in the submitted photocopy of the plan, the area was not readable, then NRC might had directed the appellant to submit the readable one; The NRC had never asked for course wise demarcation of area. This deficiency was first time mentioned in the rejection order only.

AND WHEREAS the Council noted that the building plan was approved by the competent civic authority i.e. Muzzafarpur Development authority and the institution earmarked a block with 4758.95 sq.mt. of built-up area for the teacher training programmes. The Council however noted that the appellant had been conducting M.Ed. (one year programme) and M.P.Ed. (two year programme) programmes w.e.f. 2008-09 academic session and the third batch of M.Ed. programme and 2nd batch of M.P.Ed. programme studies were in process and hence the institution had not completed three academic session and was not eligible to apply for additional course as per clause 8(3) of regulations, 2009. It further noted that the appellant submitted to the NRC notary attested copies of the land documents and self attested copy of the CLU only and it did not submit certified copies of the registered land document obtained from registrar office and notarized CLU as required under regulations, 2009. In view of the above, the Council came to the conclusion that there was no justification in accepting the appeal and that it should be rejected.

AND WHEREAS after perusal of documents, memorandum of appeal, affidavit and after considering oral arguments advanced during hearing, the Council reached the conclusion that there was no ground to accept the appeal and that it should be rejected. Accordingly, the appeal was rejected and NRC’s order dated 07-05-10 was confirmed.

NOW THEREFORE, the Council hereby confirms the Order appealed against.

WHEREAS the appeal of Shri Ram College, Muzaffarnagar, Uttar Pradesh dated 02-07-2010 is against the Order No. NRC-NCTE-F-3-UP-1199-158 Meeting-2010-21863 dated 12-05-2010 of the Northern Regional Committee, withdrawing recognition for conducting B.Ed course on the ground “The reply to the deficiency letter no. NRC-NCTE-F-3-UP- 1199-2007-15230 dated 16.04.2007 has not been received till date.”

AND WHEREAS the Correspondent, Shri Ram College (hereinafter referred to as the appellant), preferred an appeal dated 05-07-2010 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order.

AND WHEREAS Dr. S.C. Kulshreshtha, Chairman, Shri Ram College, Muzaffarnagar, Uttar Pradesh presented the case of the appellant institution on 16-09-2010. In the appeal and during personal presentation it was submitted that the appellant had always complied the letters and show cause notice of the NRC and sent letter of approval of affiliation twice to the NRC i.e. on 27.01.07 in reply to the show cause notice dt. 24.06.06 and also on 05.04.2010 through registered post in reply of last show cause notice dated 08.03.2010.

AND WHEREAS the Council noted that the Chancellor of C.C.S. University vide order dt. 28.03.06 informed the NRC that the University had decided not to extend affiliation to the appellant institution on account of certain deficiencies. In reference to this letter the NRC issued show cause notice dt. 24.06.06 asking the institution as to why the admissions were not made as per NCTE norms and land and building was not as per NCTE norms. The appellant submitted reply vide letter dt. 04.09.06 stating that the Hon’ble Chancellor of the University had directed the university to review the case and final decision in this regard would be communicated and later, the institution vide letter dt. 27.01.07 forwarded to the NRC, the decision of the university for granting permanent affiliation vide university’s order dt. 30.10.06 and enclosed a copy thereof. The NRC after referring to the institution’s reply dt. 27.01.07, issued a deficiency letter dt. 16.04.07 asking the institution to submit the affiliation letter and after a lapse of three years, it withdrew recognition of the institution on the ground that reply to the deficiency letter had not been received till date. The Council further observed that the withdrawal of the recognition on the stated ground was not in order as the appellant had already submitted the copy of the affiliation letter dt. 30.10.06 as a supporting document to his reply dt. 27.01.07. In fact NRC was not justified, after referring to this reply calling for the affiliation letter from the institution. In view of the above the Council came to the conclusion that there was adequate justification in accepting the appeal with the direction to the NRC for restoring the recognition of the institution.

AND WHEREAS after perusal of documents, memorandum of appeal, VT Report, affidavit and after considering oral arguments advanced during hearing, the Council reached the conclusion that there was enough ground to accept the appeal and that it should be accepted. Accordingly, the appeal was accepted and NRC’s order dated 12- 05-10 was reversed with a direction to the NRC to restore recognition to the institution within 15 days of issue of this order.

NOW THEREFORE, the Council hereby reverses the Order appealed against.
