O R D E R
WHEREAS the appeal of Lakhmi Chand Patwari College of Education, Baghpat, Uttar Pradesh dated 07-06-2010 is against the Order No. NRC-NCTE-F-3-UP-1213-157 Meeting-2010-20242 dated 13-04-2010 of the Northern Regional Committee, withdrawing recognition for conducting B.Ed course on the ground “The Institution has not replied letter
F.NO.- NRC- NCTE- F-3- UP-1213- 137 Meeting- 2009-7252-22 dated 30 March 2009.”
AND WHEREAS the Correspondent, Lakhmi Chand Patwari College of Education (hereinafter referred to as the appellant), preferred an appeal dated 07-06-2010 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order.
AND WHEREAS Shri Mukesh Jain, Secretary and Shri Kamlesh, Assistant, Lakhmi Chand Patwari College of Education, Baghpat, Uttar Pradesh presented the case of the appellant institution on 21.07.10. In the appeal and during personal presentation it was submitted that the appellant submitted its reply on 09.04.09 in response to the NRC’s letter dt. 30.03.09. It also submitted a reply to the NCTE Hqrs on 08.01.07 by registered post in compliance with NCTE Hqrs deficiency letter dt. 27.12.06, that was issued on the basis of an inspection report conducted under section 13 of the NCTE Act.
AND WHEREAS the Council noted that the NRC on the direction of NCTE Hqrs issued a show cause notice on 30.03.09 for certain inadequacies pointed out by the inspection team in its report dt. 31.07.06 for making a written representation within a month. The institution claimed that it had replied to this notice of NRC and also showed the receiving stamp of NRC. However the same is not available on NRC’s file. In view of this, the Council came to the conclusion that there was adequate justification in accepting the appeal and remanding the case to the NRC for considering the reply dated 09-04-09 of the institution (a copy of the reply dt. 09.04.09 of the institution is now placed in NRC’s file for its consideration).
AND WHEREAS after perusal of documents, memorandum of appeal, affidavit and after considering oral arguments advanced during the hearing, the Council reached the conclusion that there was adequate ground to accept the appeal, set aside NRC’s order dated 13-04-10 and remand the case to NRC for consideration of the reply of the institution dated 09-04-09 and for further decision thereafter.
NOW THEREFORE, the Council hereby remands back the case of Lakhmi Chand Patwari College of Education, Baghpat, Uttar Pradesh to the NRC, NCTE, for necessary action as indicated above.
