O R D E R

WHEREAS the appeal of Shri Mahipal Singh Mahavidyalaya, Hardoi, Distt., Uttar Pradesh dated 24-07-2009 is against the Order No. F.NRC- NCTE-F-7-UP-3407-141 Meeting-2009 dated 23-06-2009 of the Northern Regional Committee, refusing recognition for conducting M.Ed course on the grounds “1) CLU on prescribed format of State Govt. is not Submitted. 2) The submitted building plan is not approved by competent authority. Also the letter of approval of Building Plan from competent authority is not submitted”.

AND WHEREAS the Correspondent, Shri Mahipal Singh Mahavidyalaya (hereinafter referred to as the appellant), preferred an appeal dated 24-07-2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order.

AND WHEREAS Shri. Verendra Singh, Dy. Manager, Shri Mahipal Singh Mahavidyalaya, Hardoi, Distt., Uttar Pradesh presented the case of the appellant institution on 15-09-09. In the appeal and during personal presentation it was ubmitted that the institution was not given proper opportunity to remove the deficiencies and that no inspection of the institution was conducted before passing the refusal order.

AND WHEREAS the Council noted that as per Regulation 7(1) of the NCTE Regulations 2007, an institution was required to furnish all the requisite documents alongwith the application and that the institution failed to submit CLU and proper approved building plan even after issue of a deficiency letter. Therefore, the Council was of the view that the application of the institution was incomplete and the file was closed by the NRC on valid grounds and that there was no justification for accepting the appeal.

AND WHEREAS after perusal of documents, memorandum of appeal, affidavit and after hearing oral arguments advanced during hearing, the Council reached the conclusion that there was no ground to accept the appeal and that it should be rejected. Accordingly, the appeal was rejected and NRC’s order dated 23-06-09 was confirmed.

NOW THEREFORE, the Council hereby confirms the Order appealed against.

O R D E R

WHEREAS the appeal of Shri Mahipal Singh Mahavidyalaya, Hardoi, Uttar Pradesh dated 26-06-2009 is against the decision of NRC in its 141st meeting held on 22nd – 24th May, 2009, refusing recognition for conducting B.Ed course on the grounds “From the reply submitted by the institution it is clear that the deficiencies pointed out on the basis of inspection conducted u-S 13 exits. The reply submitted by the institution was not found to be satisfactory”.

AND WHEREAS the Correspondent, Shri Mahipal Singh Mahavidyalaya (hereinafter referred to as the appellant), preferred an appeal dated 26-06-2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order.

AND WHEREAS Shri A. Verendra Singh, Dy. Manager and Dr. Shyam Prakash, H.O.D., Shri Mahipal Singh Mahavidyalaya, Hardoi, Uttar Pradesh presented the case of the appellant institution on 19.08.09. In the appeal and during personal presentation it was submitted that the appellant institution had got all the requisite infrastructure and instructional facilities, whereas the inspection team misrepresented the facts; Further the appellant was not given any opportunity to show all the available equipments; as the Kanpur Vishvidyalaya cancelled affiliation of the institution for two years 2005-06, 2006-07, and the college was not conducting the course in 2006 at the time NCTE caused the inspection of the institution. Now University had given permanent affiliation to the institution in July’07, after causing an inspection on 16.12.07.

AND WHEREAS the Council noted that the university de-affiliated the college for two years and later on it caused inspection on 16.12.07 and accorded permanent affiliation to the institution. When NCTE’s inspection team visited the institution in 2006 the institution was not conducting the course and in the mean time of 2006-2007 the institution had complied with all the deficiencies and this was evident from the university’s inspection report. In view of the above the Council came to a conclusion that there was enough justification in accepting the appeal, to be remanded to NRC for re-inspection of the institution after receiving a payment of Rs 40000-- from the institution and thereafter pass appropriate orders.

AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, VT Report and after hearing oral arguments advanced during the hearing, the Council reached the conclusion that there was adequate ground to accept the appeal and remand back the case to NRC for causing re-inspection of the institution, after receiving a payment of Rs 40000-- from the institution, to ascertain the availability of staff in particular and other facilities as per NCTE norms and thereafter pass appropriate order.

NOW THEREFORE, the Council hereby remands back the case of Shri Mahipal Singh Mahavidyalaya, Hardoi, Uttar Pradesh to the NRC, NCTE, for necessary action as indicated above.
