NCTE appeal order for JP Institute of Education and Technology Meerut

O R D E R

WHEREAS the appeal of J.P. Institute of Education and Technology, Meerut, Uttar Pradesh dated 27-01-2010 is against the Order No. F.NRC-NCTE-F-3-UP- 1407-153 Meeting-2009-14565 dated 05-01-2010 of the Northern Regional Committee, withdrawing recognition for conducting BTC course on the grounds “The applicant institution has not submitted representation to the NRC, NCTE.”

AND WHEREAS the Correspondent, J.P. Institute of Education and Technology (hereinafter referred to as the appellant), preferred an appeal dated 29-01-2010 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order.

AND WHEREAS Shri Hariom Agarwal, President and Shri Nitesh Kumar, Office Supott. , J.P. Institute of Education and Technology, Meerut, Uttar Pradesh presented the case of the appellant institution on 15.03.10. In the appeal and during personal presentation it was submitted that the appellant’s institution was granted recognition vide NRC’s order dt. 05.08.04. And the NRC had withdrawn the recognition of the institution, on the ground that the institution did not submit representation against the NRC’s letter dt. 09.03.05 and 05.01.06. The fact was that it did not receive the quoted letters of withdrawal ground.

AND WHEREAS the Council noted that NRC granted recognition to the institution on 05.08.04. After granting the recognition, NRC vide its letter dt. 9th March’05 asked the institution the details of the faculty profile as a matter of post recognition compliance by the recognized teacher education institutions. When the NRC did not receive any reply, it issued show cause notice on 05.01.06 asking the institution to make a representation within 21 days and withdrew the recognition on 06.01.10 after almost four years of the issue of the show cause notice. There was a huge gap between the show cause notice and withdrawal orders. It also examined the faculty profile documents presented before the Council and noted that the faculty had not been selected involving the subject expert nominated by the affiliating body. In view of the above the Council came to the conclusion that there was adequate justification in accepting the appeal and remanding the case to the NRC for giving another 3 months time for appointing the faculty as per norms, selected by the selection committee constituted by the affiliating body.

AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, VT report and after considering oral arguments advanced during the hearing, the Council reached the conclusion that there was adequate ground to accept the appeal, set aside NRC’s order dated 05.01.10 and remand the case to NRC for giving another 3 months time for appointing the faculty, as per norms selected by the selection committee constituted by the affiliating body and for further processing thereafter as per regulations.

NOW THEREFORE, the Council hereby remands back the case of J.P. Institute of Education and Technology, Meerut, Uttar Pradesh to the NRC, NCTE, for necessary action as indicated above.
