About University
Avadh university which was rechristened as Dr. Ram Manohar Lohia Avadh University in memoriam of late Dr. Ram Manohar Lohia an epic socio-economic ideologue and freedom fighter par excellence. The government of Uttar Pradesh exercising the powers enshrined in the U.P. University Act, 1973 section 4 (1-A) (b), by it's notification No. 4546/ 15-10-75 dated 25 July, 1975 established University as sheer an affiliating university. The university assumed the shape of residential University in the year 1984. In the ab initio the residential segment became functional with the opening of the four departments in the campus viz. history, Culture and Archaeology, Rural Economics, Mathematics and Statistics and Solid State Physics.

Being adhered to the dictum 'slow and steady wins the race', this university had been incessantly growing. Under the prolific and peerless leadership of our present Vice-Chancellor the work-culture of the university has witnessed a phenomenal and revolutionary change. It is under his leadership that the old dictum about the work-culture has been altogether replaced by the dictum, 'Fast and forthwith progress of the university' in its every walk of life.

Introduction
Dr. Ram Manohar Lohia Avadh University or simply Avadh University is a public university located at Faizabad, Uttar Pradesh, India. Named after Dr. Ram Manohar Lohia an epic socio-economic ideologue and freedom fighter par excellence. The university assumed the shape of residential University in the year 1975. In the ab initio the residential segment became functional with the opening of the four departments in the campus viz. History Culture and Archaeology, Rural Economics, Mathematics and Statistics and Physics and Electronics. The university has nurtured other premier institutes also. Kamla Nehru Institute of Technology, Sultanpur, an institute offering Graduate & Postgraduate degrees in various Engineering streams, was affiliated to it. Later for batches commencing 2001 & onwards, this institute was brought under Uttar Pradesh Technical University.

The former name of Dr. Ram Manohar Lohia Avadh University was Avadh University, which was established by the government of Uttar Pradesh under the Uttar Pradesh University Act of 1973. Located in Faizabad, it is a state administered University and is a member of the Association of Indian Universities (AIU). The University was renamed after Dr. Ram Manohar Lohia, a freedom fighter and an eminent personality. Established in 1975, the University is a teaching cum affiliating University. NCTE appeal order for Dr Ram Manohar Lohia Avadh University Faizabad

NATIONAL COUNCIL FOR TEACHER EDUCATION

O R D E R

WHEREAS the appeal of Dr. Ram Manohar Lohia Avadh University, Faizabad, Uttar Pradesh dated 18-01-2010 is against the Order No. F.NRC- NCTE-F73-UP-1874-141st Meeting-2009-6008 dated 09-07-2009 of the Northern Regional Committee, refusing recognition for conducting M.Ed. course on the grounds “ 1) The list of appointed faculty as per NCTE Norms has not been submitted till date.“

AND WHEREAS the Correspondent, Dr. Ram Manohar Lohia Avadh University (hereinafter referred to as the appellant), preferred an appeal dated 18-02-2010 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order.

AND WHEREAS Dr. Ashok Shukla, Reader, Dr. Ram Manohar Lohia Avadh University, Faizabad, Uttar Pradesh presented the case of the appellant institution on 21-10-2010. In the appeal and during personal presentation it was submitted that, in anticipation of possible recognition the appellant had advertised for the teaching posts (copy of advertisement attached), in response of which few applications were received, and those fulfilling the prescribed qualifications were called for interview before a legally constituted Selection Committee comprising subject experts in March, April 2010, (copy of composition of selection committee attached). The selection committee after interviewing the candidates recommended three names to the Executive Council and the appellant appointed them as teachers in the M.Ed. Faculty. In addition, the fourth lecturer was appointed after issuing the conditional recognition following the same process. The nature of the appointments made by the appellant was 'regular' and 'full time'. The use of the term 'Contract' by the appellant in its documents submitted to the Regional Committee, was interpreted by the Regional Committee in and entirely different context than reasonably possible.

The word 'Contract' may have two meanings (a) persons may be engaged to teach in the course on contractual basis by entering in to a negotiated agreement on payment per lecture without any service conditions and disciplinary control. This is a contract for services. (b) person may be engaged in the service of the institution under its disciplinary control, salary prescribed by the institution. 'Contract' in this case being an agreement on the part of employee to abide by the conditions of service. This is control of service'. But the academic nature and quality of the course is in no way different and inferior from the grantin- aid courses. By its very nature, the teachers appointed in such a course can
not be appointed till the age of retirement. They can only be appointed till such time the course continues to run. But this does not affect the regular nature of their appointment. Thus, the Regional Committee failed to appreciate the selffinancing nature of appellant's M.Ed. course which resulted in refusal of its recognition.

AND WHEREAS the Council noted that the appellant preferred an appeal against the refusal order of the NRC and the same was not admitted by the Council, owing to the delay in preferring the appeal and the decision of the Council was conveyed vide letter dt. 14-07-2010. Aggrieved by the decision of the Council, the appellant preferred an appeal before the Hon’ble High Court of Jurisdiction at Allahabad at Lucknow and the Court vide their judgement dt. 01- 09-2010 set aside the order dt. 14-07-2010 passed by the NCTE and the petitioner is permitted to make a fresh representation and approach before the said authority within a period of two weeks from the judgement and the NCTE i.e. Chairman-Member Secretary, National Council for Teachers Education, New Delhi, shall consider and decide the case of the petitioner on merit, in accordance with law. In compliance with the Court directions the appellant submitted a representation vide letter dt 15-09-2010 which was received in the office of NCTE on 21-09-2010. Accordingly the case was heard on 21-10-2010.

AND WHEREAS the Council further noted that the appellant was issued conditional recognition vide letter dt. 08-08-2006 to appoint the duly selected staff with the requisite qualification as per NCTE norms on regular basis and to provide additional journals in the library. The institution vide letter dt. 25-08-2006 forwarded the copy of the advertisement, selection committee minutes and also list of journals. NRC after considering this reply asked the institution vide letter dt. 10-09-2007 to submit consolidated staff list appointed on regular basis, proceedings of the selection committee, Bio-data of the selected faculty, affidavit of Rs. 100-- stamp paper. Thereafter the NRC refused recognition on the stated ground after considering the reply submitted by the institution. The file of NRC did not contain any reply submitted by the institution, sent in response to the NRC’s letter dt. 10-09-2007 and also NRC had not issued any show cause notice before refusing recognition. The Council also perused the faculty profile submitted by the institution and noted that only three lecturers were appointed, further it had advertised on 13-09-2010 for rest of the faculty and the University has already fixed the date of selection committee meeting on 20-11-2010. The Council therefore decided to give two months time for appointing the faculty as per the NCTE norms, in the light of the council’s decision taken in its 25th meeting held on 23-03-2010 with regard to appointment of the faculty in the M.Ed programme.

AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, and after considering oral arguments advanced during the hearing, the Council reached the conclusion that there was adequate ground to accept the appeal and reverse the NRC’s order dated 09-07-2009 with direction to the NRC to give two months time for appointing the faculty as per the NCTE norms, in the light of the Council’s decision taken in its 25th meeting held on 23-03-2010 with regard to appointment of the faculty in the M.Ed programme.

NOW THEREFORE, the Council hereby reverses the Order appealed against.

All I have left is hope for justice

Today, when the Lucknow bench of the Allahabad High Court ordered the Uttar Pradesh government to pay Rs 5 lakh as compensation to me, I am silent. I dont know how to react. I am not hoping for a miracle and I know my left leg has been amputated. My life is not going to be the same again and I will have to deal with pain and my disability. I am worn out, physically and mentally.

Several doctors and nurses keep popping in and out of my room, each one of them smiling and introducing themselves, describing what their function would be in my treatment. I know their ultimate goal is to get their patients back on their feet, back to their old lives. But to me, this is confusing and intimidating. Why should all these people be interested in me? After all, I will never lead a normal life again. My mother, who is always sitting next to my bed, keeps wiping away my tears and consoling me, but I know that it will take a lot of time to bring back that full-on approach to life in me again.
Earlier, when the Indian Railways offered me a job, I thanked them but made it clear I would pursue my war against the injustice meted out to me. I didnt lose my leg in an accident. I lost it because I was thrown off a train by vandals.

It was a day like any other. I boarded a compartment of Padmavati Express from Lucknow to Greater Noida, and then, my world came crashing down. I resisted a chain-snatching attempt by some hoodlums. They threw me out of the speeding train somewhere near Bareily, and as a result, I am now left a cripple. My left leg fell under the wheels of another train coming from the opposite direction. Railway policemen carried me to the local district hospital where I stayed, not only injured, but traumatised.

Now, the Railways job has come to me on a platter without having to search high and low for it, albeit after a major tragedy. But this does not mean that my story has ended. I urge the police administration not to become complacent; instead, they must follow the trail of the culprits aggressively.

I was born in a poor family, and had quite a difficult childhood with my parents somehow making ends meet. I was only 12 years old when I started thinking that the only way to get my family a new lease of life was to do something special in sports. I played football and volleyball in a government school that I attended in Ambedkar Nagar, and slowly became good at these sports. Within a year, I realised that I was more skilled in volleyball.

It wasnt easy. I had to fight it out with male volleyball players. I performed so well that finally, I was selected to play for UP. Then on, I represented my state in a number of national-level tournaments. And I dreamt of representing my nation in the Olympics. Under the guidance of my sports teachers at school, I trained harder and harder.

The first time I got to show off my hard-earned skills was in 2002, when I was selected to represent my states Under-16 for the nationals. We finished runners-up in the tournament. I came to be considered as one of the best junior athletes in the country. My life was at an all-time high.

Even when I was doing well, things often got difficult. As my profile as a sportswoman grew, people in the sports circle recognised me but sometime in 2008 I contemplated quitting due to financial constraints. My mother and brother were against it though. They said, God has given you the skill, keep working hard. It was around this time that I realised that I would be able to continue with my career in sports if I kept up my university education. I had then just finished my BA from Awadh University and later joined an MA in sociology through a sports quota. In the two years that I was pursuing my Masters, I got many more opportunities to play games at the national level. I started thinking that it wouldnt be long before I would be playing for my country in a mega-international event like the Olympics or Asian Games.

Life was looking good for me. But now, I have had it taken away from me. I am depressed and angry about losing my leg. My family is going through the worst time possible. I dont know how long it will be before I am discharged from the hospital. I wish I could walk again to the volleyball fields where I spent hours practising, loving my life. The only hope I have now is that some day the vandals who threw me out of the train will be brought to justice.

BEd counselling off to a harried start, extended till late night

KANPUR: The students who went to attend the much-awaited BEd counselling here on Friday on its first day were a harried lot as it got extended till late in the night at various centers. The counselling also commenced a bit late as usual followed with serpentine server fluctuations.

Hundreds of students had turned up at five centers for BEd counseling, including Computer Centre, Kanpur University, DAMS Management Institute, SSA Institute, Naraina Institute of Management and Naraina Institute of Information Technology and Management. The long wait due to snag in the computer server gave the students a tough time. Reportedly poor management at the centers also gave a late start to the counselling. Even the registration work was not concluded at various canters till 4 pm.

It is important to mention here that the BEd counseling, which was to start from June 8 at 9 am, could not begin till 12 noon. This three hours delay was due to mismanagement at the centres. This time Ram Manohar Lohia Avadh University conducted the BEd exam across the state.

A senior faculty member of Chhatrapati Shahuji Maharaj University, Kanpur, confirmed that the counselling began a bit late which forced the students to wait as they had no other option. The long delay occurred due to slow registration processes as well. The students had reached the university campus before the reproting time of 9 am and carried out the basic formalities to participate in the counselling session.

Once this was done, the students were allowed to sit for the choice filling session so that they could choose a college of their liking. Several students on this occasion locked their college of preference and left the centre with fingers crossed, hoping that they would get their preferred college. Most of the city-based students gave preference to those colleges that run BEd course in the city. Outstation candidates tried locking those colleges which were either situated in their city or was in the vicinity of their place.

It was in this entire fashion that the counselling went on across all the five centres in the city.

At the time of filling of this report, 470 students at Computer Centre, CSJMU, had completed their choice filling. While, only 50% steudents were able to fill their choice at other centers till 9 pm, said Sandeep Singh, BEd counselling co-ordinator at Camputer Centre, CSJM University.

He also informed that the counselling at the other three centres was continuing and may end late in the evening.

This had happened due to the server snag and the slow speed of counselling.
