The petitioner, who is working as Lecturer (Electrical Engineering) in Chhotu Ram State College of Engineering, Murthal, District Sonepat - respondent No.3, has filed the instant petition under Article 226 of the Constitution of India, for directing respondents No.1 to 4 to grant him the same pay scale from the same date, as has been granted to respondent No.5, who is junior to the petitioner, with all consequential benefits.

In the petition, it has been stated that the petitioner was appointed as Lecturer in Electrical Engineering in the respondent college on
29.9.1995 in the pay scale of Rs. 8000-13500. On 29.9.2001, after
completion of 6 years of service, the petitioner was granted the Time Scale (Senior Scale), and after completion of further 5 years of service, on 29.9.2006, he was granted the next Time Scale/Assistant Professors Scale.

The grievance of the petitioner is that respondent No.5, who was appointed as Lecturer in Mechanical Engineering on 16.9.1996 and was junior to the petitioner, was granted the Time Scale (Senior Scale) on 27.7.1998 and the second Time Scale/Assistant Professors Scale on 27.7.2002. Therefore, in granting of these benefits, the petitioner was discriminated and he is also entitled for these two Time Scales with effect from the date, the same were granted to his junior (respondent No.5).

In the written statement, though it has been admitted that respondent No.5 was appointed on 16.9.1996 and he was junior to the petitioner, but it has been stated that before joining the service in the respondent college, respondent No.5 was working as Lecturer in Mechanical Engineering at Vaish Technical Institute, Rohtak from
16.4.1991 to 15.9.1996. It has been further stated that in view of the
notification dated 30.1.2004, respondent No.5 was given the benefit of the previous service and the said service was added in his qualifying service for the purpose of grant of aforesaid two scales.

By taking into consideration the said period of previous service, respondent No.5 was granted the Time Scale (Senior Scale) with effect from 27.7.1998 and the Selection Grade with effect from 27.7.2003, after completion of 6 years and 5 years of service, respectively. Hence, the question of disparity with the petitioner and stepping up of his pay does not arise.

The aforesaid factual position has not been controverted by the
petitioner, while filing the replication. No case has been set up in the
replication that respondent No.5 was not entitled for the benefit of the counting of the past service rendered by him in Vaish Technical Institute, Rohtak.

In view of the aforesaid factual position, the respondents have rightly granted the Time Scale (Senior Scale) to the petitioner on
completion of six years of service on 29.9.2001 and the next Time Scale/ Assistant Professors Scale on 29.9.2006 after completion of further 5 years of service. It is the conceded position that the petitioner does not have any previous service to his credit.

No merit.

1. The dispute raised by the workmen through the demand notice was that they had been performing duties as Lab Attendants in as many as 31 different labs in the Chhotu Ram State College of Engineering and being cast on a pay scale of Rs.750-940/-, which was lower than the scale of Lab Attendants in other Government Engineering Colleges. According to them, they were entitled to higher scales of pay and they were entitled also to be re-designated as Lab Attendants.

2. The management contended that Peons-cum-Attendants, to which designation the workmen had been assigned, held Class IV posts and a re-designation that they were seeking as Lab Attendants was Class III posts carrying higher scales of pay and the Labour Court had not the competency to change the cadre and admit to the workmen
a higher scale of pay. The Labour Court found on evidence let in before it that the persons who had been designated as Peons-cumAttendants were actually performing the duties as Lab Attendants at the various labs in the Engineering College and hence they were entitled to be re-designated as Lab Attendants and they were also entitled to a higher scale of pay w.e.f. 01.05.1990 with a direction that no further recruitment of non-matrics as Lab Attendants shall be made by the management institution.

3. Learned Counsel, Sh. Nalwa appearing on behalf of the State represented through the Director Principal of the College had filed some additional documents before this Court, which referred to the actual sanctioned strength as ordered by the Governor of Haryana vide his letter dated 06.05.1987. As per the said communication, there were three Lab Technicians in the pay scale of Rs.480-760/- (prerevised), three Lab Attendants (Non Matric/Matric) in the pay-scale of Rs.350-500/- and Rs.400-660/- respectively. The sanctioned posts of Peons were 4. By a subsequent communication dated 03.08.1988, sanction had been accorded for 7 Attendants in the pay scale of Rs.750-940/-, amongst other posts. Under a communication dated 19/24.10.1988, the nomenclature of the Lab/Workshop Attendants (Matric) became Laboratory Assistants and Lab Attendants (nonmatric) became merely Attendants. These documents were objected to by the learned counsel appearing for the respondent that they had not been filed before the Labour Court and no reliance could be made.

However, I find that these communications are merely details regarding the sanctioned posts and the various designations that were available. It is not as if the workmen could complain that they were being taken by surprise. After all along the contention on behalf of the management was that the Labour Court did not have jurisdiction to upgrade the Peons-cum-Attendants, who were Class IV employees to higher class namely of the Lab Attendants, who are Class III employees. I, therefore, receive those documents as relevant in this case.

4. It is not denied that the Peons-cum-Attendants were Class IV employees and Lab Attendants presently designated as Lab Assistants are Class III employees. The Labour Court had examined the evidence of the witnesses on both sides and found that the Peonscum-Attendants were actually assisting the Lab Technicians and that they were employed to help the Lab Technicians for maintenance and work in the class. The Foreman examined on the side of management had specifically admitted that when the claimants-workmen worked in the Lab, they did work of Lab Attendants. He explained on his own that they did the work of cleaning tool equipments, furniture etc., giving tools to students and helped the technicians in maintenance and other help. Through the Registrar, the management sought to contend that AICTE had prescribed norms for affiliation and stated that while they had followed the norms set by AICTE for teaching staff, they did not follow the norms for Laboratory staff. He admitted that there were
84 laboratories but said that they did not have any posts as Lab Attendants. He also admitted that Peons-cum-Attendants, who had been so employed actually worked in the Labs. In view of the specific admission made by the Registrar that they had not complied with the norms of the AICTE and they had the Peons-cum-Attendants working also in the Labs, the Labour Court applied the scales that were applicable to Lab Technicians in Engineering College Kurukshetra where they held the higher scales of pay of Rs.950-1500/- and accorded to them such a higher scale on the principle of equal pay for equal work and directed the higher scales of pay to be given.

5. It should be seen that the principle of equal pay for equal work is not to be adopted in a mechanical fashion. The burden of proof that they were doing the same work as was being done elsewhere by other pesons who held higher scales of pay to merit
claims to parity shall always be on the workmen, as held recently by a judgment of the Honble Supreme Court in U.P.S.E.B and another Vs. Aziz Ahmad (2009) 2 SCC 606.

The Honble Supreme Court also enunciated that the principle shall be applied not merely by the same work that is done but it should be ascertained also that the duties and responsibilities accompanying such post must been seen as identical (Director General of Works, CPWD Vs. Regional Labour Commissioner (Central) and others (2008) 2 SCC 589). The Honble Supreme Court also illustrated through several examples in another decision in State of Haryana and others Vs. Charanjit Singh and
others (2006) 9 SCC 321 that cases like special scales to prevent a stagnation, strict selection process to identify certain classes of persons of higher merit for performing the same work might still merit consideration of higher scale of pay. In this case, there was an admission by the Registrar that the College had not the required strength of Lab Attendants as prescribed by the AICTE norms and had allowed the Peons-cum-Attendants to also work as Lab Attendants.

At the same time, there was also evidence through the admission of the workmen themselves that they also worked in offices and whenever they worked in the Labs they worked as Lab Attendants.

Learned counsel appearing for the workmen stated as a proposition of law that a High Court exercising jurisdiction under Artile 226 shall not interfere with definite findings of the fact and when the Labour Court had held that the workmen had been doing the work as Lab Attendants, the same cannot be interfered with and the scale of pay accorded to them at par with Lab Attendants elsewhere in the Engineering College, Kurukshetra ought not to be interfered with. I affirm the finding of the Labour Court that all the workmen were doing the work of Lab Attendants and they were entitled to a higher scale of pay of Rs.950-1500/- (pre-revised) and a calculation of the same upto the date of judgment of the Labour Court is approved by this judgment.

6. Even while affirming the finding of the Labour Court, I cannot uphold the direction by the Labour Court re-designating the Peon-cum-Attendant as Lab Attendant and permanently increasing the scales of pay to Rs.950-1500/- with a further embargo caused on the management to recruit non-matriculates Lab Attendants. The order given by the Labour Court would virtually amount to re-writing the cadre strength.

Creation/abolition of posts, formation/restructuring of cadres, upgradation of cadres or determining cadre strength are all matters that fall in employers domain that Courts shall be loathe to make judicial intervention. Please see Union of India Vs. S. Thakur
(2008) 13 SCC 463; Union of India Vs. Pushpa Rani (2008) 9 SCC 242. If the Government had not provided for a higher cadre in Class III to accord with the AICTE norms, it shall be for the AICTE to make the institution conform to its regulation. The evidence of the Registrar making an open defiance that they have not conformed to the norms of AICTE with reference to the non-teaching staff is as candid as it is
unacceptable. The workmen or any interested party shall have appropriate remedy through representation also to AICTE to make them conform to the regulations. The parity of pay that the Labour Court has ordered, I have restricted it only upto the date of the judgment of the Labour Court and direct that it would not operate for any period subsequent to the judgment. Since the judgment has been rendered on the basis of evidence and on factual considerations which I am not inclined to interfere, it does not, however, mean all the Peons-cum-Attendants shall bear a nomenclature as Lab Attendants. I have already pointed out that the workmen were also working in offices as Attendants and it would be inappropriate to extend the equal pay for equal work doctrine without finding that all the workmen are employed only as Lab Attendants at all times and continue to be employed as such till date. It has to be seen on a case to case basis and without any evidence, till date, such an increase in scale of pay by a permanent arrangement through an order of the Court cannot be made. In retaining the workmen only in the cadre of Peons-cum- Attendants in Class IV category, I make it clear that it will also be open to the affected workmen to make appropriate representation to the government to have them re-designated appropriately for actual
work done by them on a permanent basis. Independently of what workmen may opt to do, the Government is hereby directed to consider the actual condition prevalent now and take a decision about the feasibility of increasing the cadre strength to conform to AICTE norms as expeditiously as possible.

7. The order of the Labour Court is set aside and modified to permit the workmen to obtain a higher scales of pay (pre-revised) at Rs.950-1500/- only upto the date of the order of the Labour Court and the direction of the Labour Court re-designating them as Lab Attendants is set aside. The directon against the management for recruiting non-matriculates as Lab Attendants is also set aside. The writ petition is ordered in the above terms.

Introduction

The Deenbandhu Chhotu Ram University of Science and Technology, formerly known as CR State College of Engineering (CRSCE), Murthal started in 1987 and is the first government engineering college in the State of Haryana.

Road) 48 Km. from ISBT, New Delhi towards Chandigarh. The location of university falls within one of the fastest growing industrial belt of Haryana. The University is spread over 273 acres and has a fully residential campus with ample built up space in a contemporary architectural idiom.

Deenbandhu Chhotu Ram University of Science and Technology (DCRUST) is situated in Murthal (Sonepat) on National Highway Number 1 in the state of Haryana. The University is housed on a sprawling campus of several acres. It has evolved from CR State College of Engineering, Murthal that was established in the year 1987-88 as the first Government Engineering College in the State of Haryana. It has been named after the great freedom fighter and reformer Sir Chhotu Ram.

History

The Institution started with Mechanical Engineering, and Electronics and Communication Engineering, with an intake of 30 students in each branch. Other disciplines were added and at present there are eight under graduate courses and three P.G. Courses. The undergraduate courses are Computer Science and Engineering, Electrical Engineering, Electronics and Communication. Engineering, Mechanical Engineering, Chemical Engineering, Architecture, Bio-Technology, Bio-Medical. P.G. courses constitute Electrical Engineering, Mechanical Engineering and MBA (IT). There is an intake of 370 students in under graduate courses and 66 in P.G. courses. All the courses of the college has been approved by the AICTE and the college was affiliated to M.D.University, Rohtak for the purpose of conducting the examination and awarding of degrees.

The Government of Haryana upgraded the college to Deenbandhu Chhotu Ram University of Science & Technology in 2006. Admissions to UG courses is through AIEEE.

On 17 February 2009 the foundation stone of CIPETwas laid by Sh. Ram Vilas Paswan in the University.

Location

DCRUST, Murthal is located on National Highway No. 1 at a distance of 50 km from I.S.B.T., Delhi and at a distance of 8 km from Sonipat railway station. The sprawling campus of the College has been developed on 273 acres (1.10 km2) of land which falls within the industrial and commercial belt extending from Kundli to Panipat. The site has a strategic location in that it is near the national capital while being in the clear unpolluted environment of the country side.

Deenbandhu Chhotu Ram University of Science and Technology offers professional and job oriented programmes in the fields of engineering and management. Presently, it offers 8 undergraduate courses and 3 postgraduate courses in several engineering disciplines.

Apart from all the engineering disciplines, DCRUST offers Master of Business Administration program with specialization in Information Technology. All the technical courses offered by the University have been approved by the All India Council of Technical Education, AICTE, New Delhi whereas the course of Bachelor of Architecture is approved by the Council of Architecture.

Top ten percent meritorious students of each branch are provided with scholarship by the University. SC, ST and other backward class students can also avail scholarship facility as per government norms.

Admissions in the B Tech courses are done by Haryana State Counseling Society (HSCS) through online counseling on the basis of marks scored in the AIEEE entrance exam. For pursuing B Architecture in the University, one needs to clear NATA exam. MBA admissions are done by the HSCS through online counseling on the basis of MAT Score.

Facilities
The university campus provides all the basic facilities like hstels for students and staff, dispensary, shopping center, bank, post office and guesthouse etc. There are separate hostels for boys and girls, where one can avail single seated rooms, with ample recreational and mess facilities.

There is a University library that has a good collection of textbooks (Science & Engineering), conference proceedings, technical magazines and journals. The university has established a placement cell that looks after the campus placement and ensures that the students are placed with reputed organizations.

Shri Har Sarup Chahal has been the Vice Chancellor of Deenbandhu Chhoturam University of Science & Technology, Murthal since Feb 2008.With his dynamic leadership he wants the university to excel in the field of education as well as to emerge as corporate. Soon after his taking over as the Vice Chancellor of the university various schemes were launched and initiatives were taken to to develop this university as centre of excellence for higher technical education in the region. Under his visionary approach university has emerged as an infrastructural hub as well as is ready to expand educational frontiers in various emerging technologies. Under his visionary leadership university is now fully prepared to offer various technical/professional courses at Under Graduate level as well as at Post Graduate Levels to meet the increasing needs of millennium & to cater the technical education demands of the NCR region. At present university is offering 16 Post Graduate programs & 9 Undergraduate programs & more courses of high relevance are in pipeline. It was the Dedication, Determination and Dynamism of Hon'ble Vice Chancellor, that made it possible, to start large no. of courses of high relevance in such a short span of time.

Sh. Har Sarup Chahal was born on 6th May, 1949 hails from a small hamlet Nimri of Bhiwani Distt.Of Haryanawas and Spent his childhood and had schooling from Jat Heroes Memorial Anglo Sanskrit Higher Secondary School, Rohtak. He belongs to a family of academations. His father was a renowned Headmaster of Jat School and Vaish School Rohtak who was awarded State Award for Teachers by Govt. of Punjab. All his three sisters were teachers. His wife was Reader of Economics in Lady Shri Ram College, New Delhi and later founder Principal of Bhagini Nivedita College at Kair, New Delhi. Graduated in Civil Engineering and obtained Post Graduate Diploma in Highway Engineering from the coveted Panjab Engineering College, Chandigarh with First class First Position.Sri H. S. Chahal was first selected as Lecturer in Regional Engg. College, Kurukshetra but later joined Haryana Irrigation Deptt. for a short spell.Topping the Select list of Haryana Public Service Commission, made his career in Haryana Public Works Department (Buildings and Roads) where he rose from an Assistant Engineer to the highest rank of Engineer-in-Chief.Sh. Chahal was also Managing Director of Haryana State Roads & Bridges Development Corporation and General Manager in National Highways Authority of India.

In his career of an 'Engineer' spanning 37 years he successfully completed many mega projects of Haryana PWD, Delhi Development Authority and National Highways Authority of India namely:

Mini Secretariat at Gurgaon, Haryana Bhawan at New Delhi, Player's Building at Indira Gandhi Stadium, I. P. Estate, New Delhi (presently housing Delhi Govt. Sectt.) Natoinal Highway Development Programme of NHAI in the States of West Bengal, Jharkhand, Rajasthan, Haryana and Andhra Pradesh

Sh. Chahal, A renowned ' Highway Engineer' was Council Member and Vice President of Indian Roads Congress-a body which sets Standards & Specifications for road construction in the country. Also member of Rigid Pavement Committee and Highway Planning, Transportation and Road Safety Committee of Indian Roads Congress where he is a Life Member.Fellow of Institution of Engineers (India). He is on the Boards of Directors of WARCO's (Ministry of Water Resources. G.O.I.). He has Authored and presented many technical papers on Road safety in Indian and foreign journals.

A sportsman making strides in Badminton and Lawn Tennis. A keen golfer who achieved 'Hole - in - One' at Panchkula Golf Club.

Other interest of Sh. Chahal is theatre and its comedy roles.
