Appointment of Chhina as Improvement Trust chief irks Sidhu

Even as the general secretary of the state BJP Rajinder Mohan Singh Chhina claimed that he would take over as chairman of the Amritsar Improvement Trust within the next few days, there was no confirmation from the BJP regarding the post.

National leadership of the BJP was seized of the matter as MP Navjot Singh Sidhu reportedly did not approve of Chhina’s elevation. Sources in the party maintained that Sidhu asked the leadership as to what yardstick had been used to appoint leaders to the posts of trusts and boards. They said Sidhu pointed out that he had been trailing by 30,000 votes from the west constituency in the Lok Sabha election from where Chhina had contested the assembly elections.

The central BJP leadership is learnt to have given time to hear Sidhu on Monday (July 6) while they listened to the Punjab leadership of the BJP yesterday.

Sidhu objected that the state leaders of the BJP did not consult him before elevating a leader from his area.

Meanwhile, Chhina maintained that though he could join the office on any day but he has been waiting for the central and state leaders of the party to spare time to bless him on the occasion of swearing in.

He brushed away rumours of his differences with Sidhu and added that he was unaware on how a communication gap remained and the local MP was not informed beforehand of his appointment.

He stressed that his relations with Sidhu were cordial and he would invite him (Sidhu) to participate when he joins office.

Having associated with two leading educational and art organisations of the city for the past many decades, Chhina had been a known face in the academic circles. He dabbled in politics for the first time by joining the saffron party two-and-a-half-years ago.

Hence, Chhina’s elevation was appreciated by intelligentsia, artists and academicians besides rank and file of the BJP. The Indian academy of Fine Arts and Kishore Kumar Memorial Society appreciated appointment of Chhina as Chairman of Improvement Trust.

Installation of Chhina as Chairman put off again

Installation of Rajinder Mohan Singh Chhina, secretary of the state BJP who was expected to take charge of the all-important post of Chairman, Improvement Trust, has again been postponed due to the unbending stand taken by Navjot Singh Sidhu, party’s MP from Amritsar.

Fissures in the rank and file in the local BJP had come to the fore much before the parliamentary elections.

However, the differences between Chhina, who is also secretary of Khalsa College Management Committee, and Sidhu had widened after the Lok Sabha elections.

Sidhu had a grouse that he got about 20,000 votes less in the Amritsar (West) assembly constituency represented by Chhina.

The plain-speaking by Sidhu at the Jalandhar meeting in which he blamed the state leadership for the dismal performance of the party in the Lok Sabha poll had also irked senior leaders.

However, despite the direct intervention of the party high command, Sidhu refused to bury the hatchet so far as question of installing Chhina as Chairman of the Improvement Trust is concerned.

However, Chhina told The Tribune that he was likely to take the charge as Improvement Trust Chairman in the next couple of days. He said Manoranjan Kalia told him that the matter would be resolved shortly.

On the other hand, Navjot Sidhu maintained a stoic silence and refused to air his views about the appointment of Chhina.

A BJP leader from New Delhi on the condition of anonymity said party President Rajnath Singh and L.K. Advani discussed the matter. Till the filing of this report in the evening they had not arrived at any decision.

Meanwhile, the Akalis put their weight behind Chhina as they visited his residence to congratulate him for his elevation to the coveted post.

Inder Bir Singh Bolaria, Dr Balbir Singh Verka, both Akali MLA, Bawa Singh Gimanpura, district President, SAD, and Akali councillors led by Senior Deputy Mayor Ajaybir Pal Singh Randhawa welcomed the appointment of Chhina.

Health Minister Laxmi Kanta Chawla and BJP MLA Anil Joshi had also visited the house of Chhina to congratulate him upon his elevation.

Principals of colleges being run under Khalsa College Management Committee also honoured Chhina at a gurdwara located inside Khalsa College yesterday.

On 19.05.2010 order regarding status of the Respondent in terms of Section 2(h) of the RTI Act, 2005 and provision of information to the Complainant was reserved.

2. The case relates to seeking copies of proceedings of meetings held by the Managing Committee of Khalsa College Governing Council, Amritsar, on 01.08.1990, 28.11.1990 and 16.08.1993. Initial request was sent on 19.01.2009 and on not getting a response, the Complainant filed an undated appeal with the Commission received in the office of the Commission on 14.10.2009.

The Respondent through various submissions has stated that the Respondent is not a ‘public authority’ in terms of Section 2(h) of the RTI Act and thus, will not be able to entertain the request of the Complainant for the provision of the information. However, the Respondent through a written submission on 27.11.2009 had stated “that in any case information required by the applicant has already been given.”

4. Subsequently, the Respondent retracted from his initial stance after it was known that no information had been provided to the Complainant. Later, the Respondent on 15.02.2010 assured the Commission that information will be made available to the Complainant. The Respondent on 08.03.2010 again retracted from his statement/request and through an oral submission pleaded that Para 4 in written response dated 27.11.2009 be “deleted.” This was recorded in the order dated 08.03.2010. Interestingly, therefore, the stand of the Respondent has been vacillating.
5. In order to assist the Complainant in obtaining information, it was directed that Dr. Daljit Singh, Principal of Khalsa College, who, by his designation, is an ex-officio
member of the Managing Committee, Khalsa College Society, Amritsar, should provide a copy of the information. These directions were issued based on the fact that Khalsa College is a public authority in terms of Section 2(h) of the RTI Act. He was also directed to appear before the Commission with a copy of the information on 19.05.2010.

6. Dr. Daljeet Singh, Principal, Khalsa College, appeared before the Commission on 19.05.2010. He submitted an affidavit, dated 18.05.2010. Through this affidavit, he has brought out following facts:-

(a) “That the Khalsa College Governing Council, Amritsar, established in 1892 is the Governing Body of about 15 Institutions including Khalsa College, Amritsar. The Khalsa College Governing Council has a separate office and an independent, separate secretariat of its own.
(b) That I am not a member of the Khalsa College Governing Council, Amritsar, muchless an ex-officio member.
(c) That the contents of the letter no. 783, dated 06.04.2010 addressed to your goodself by the undersigned may also be taken into consideration.
(d) That S. Jaswinder Singh has sought information from Public Information Officer O/o Managing Committee, Khalsa College Governing Council, Amritsar. The information is not in my custody and possession. These are not even maintained by the office of Khalsa College, Amritsar. The information sought for does not pertain to the office of Principal, Khalsa College, Amritsar.”

7. He has also stated that there are two separate bodies i.e. the Governing Council and the Managing Committee.

I have carefully pursued all documents placed on record and it has clearly emerged that the Complainant filed a request for information with the PIO/APIO Managing Committee, Khalsa College Governing Council, Amritsar, on 19.01.2009 which is not the custodian/initiator of various proceedings pertaining to Khalsa College Governing Council, Amritsar. Thus, the application for information was addressed to an authority which is neither the custodian nor the executing authority of directions of Khalsa College Governing Council, Amrtisar. Had the Complainant applied for the copies of the proceedings held on 01.08.1990, 28.11.1990 and 16.08.1993 to the appropriate authority then, perhaps, this case would not have been prolonged for a period of approximately 17 months.

9. In view of the foregoing, the appeal of the Complainant is dismissed being without any merit.

This case has recently been transferred to this Bench. It was earlier listed before Hon’ble State Information Commissioner, Mr. R.K. Gupta. The applicant vide his request for information under the RTI Act dated 19.01.2009, had sought copy of extract of complete proceedings of meetings held by the Managing Committee of Khalsa College, Governing Council, Amritsar on 01.08.1990, 28.11.1990 and 16.08.1993.

2. The Respondent has made a written submission to the Commission on 27.11.2009, inter alia stating that the Respondent Managing Committee is not a public authority and is not under the Jurisdiction of the Commission. In the same submission, the Respondent further says at Sr. No. 4, “that in any case, the information required by the applicant had already been given.”

3. The Complainant says that he has not received any information.

4. Mr. Upneja says that he got a telephonic message from the Respondent today morning to appear on his behalf. He is unable to answer the question that if the Respondent is not a public authority, as per written submission dated 27.11.2009, how come the information has been provided?

5. The Respondent says that he will tell the Managing Committee of the Khalsa College Governing Council, Amritsar to supply the requisite information again as per the submission dated 27.11.2009. The Respondent is directed to send a copy of the information to be sent to the Complainant to the Commission as well before the next date of hearing.

Vide application dated 08.02.2011, the complainant had sought the following information:

“Following regarding Ms. Jaspreet Kaur, my daughter:

1. Date from which the Provident Fund deductions were started as also the details of credit of provident fund amount as sent by M/s Thapar Corporation’s R & D Centre, Patiala;

2. The total amount of PF to the credit of Ms. Jaspreet Kaur w.r.t. her contributions, employer’s contributions and the interest accrued on the total amount till date;

3. Inform me the procedure to get the aforesaid amount refunded to me on her behalf as per her authority in my name.

4. Names & addresses of your other ex-employees whose PF is withheld on similar grounds i.e. termination of service due to refusal by you of their leave without pay.”

The instant complaint was filed with the Commission on 19.05.2011 stating that no information was provided.

Sh. Sanjeev Kaushal, counsel for the Society appeared and submitted a letter dated 01.07.2011 wherein information on points no. 1 to 3 is contained. A copy of this is handed over to the complainant. Sh. Kaushal further submitted that although they are providing the information under RTI Act, 2005 in this case, they are not a Public Authority as defined in Section 2(h) of the RTI Act 2005 but only a Charitable Society and hence not governed by the said Act.

Regarding information on point no. 4 of the original application, he submitted that they have no such employee whose PF dues are withheld on the similar grounds i.e. termination of service due to refusal of their leave without pay.

With this, the complainant felt satisfied.

Seeing the merits of the case, therefore, it is hereby closed and disposed of.
